«Փաստ» օրաթերթը գրում է

Բարձր տեխնոլոգիական արդյունաբերության նախարարությունն առաջարկում է լրացում կատարել կառավարության 2002 թ. հոկտեմբերի 3-ի N 1584-Ն որոշման մեջ: Նախագծի հիմնավորման մեջ նշվում է, որ «Տեղեկատվական տեխնոլոգիաների պետական աջակցության մասին» օրենքի 7-րդ հոդվածի 2-րդ մասի համաձայն, նախարարությունը վարում է տեղեկատվական տեխնոլոգիաների ոլորտի վարչական ռեգիստրը, որը ներառում է ՀՀ-ում գրանցված տնտեսավարող սուբյեկտների փաստացի գործունեության կամ տնտեսավարող սուբյեկտի կառավարման գործադիր մարմնի վայրի, աշխատողների քանակի, օտարերկրյա մասնակցության, արտադրանքի, մատուցված ծառայությունների ծավալի, արտահանման, ներդրումների, եկամուտների և այլ ցուցանիշների մասին շարունակական արդիականացման ենթակա տվյալների բազա:

Նույն օրենքի 16-րդ հոդվածի 2-րդ մասի համաձայն, հարկային մարմինները պարտավոր են իրենց մոտ առկա տեղեկությունները յուրաքանչյուր եռամսյակ տրամադրել նախարարությանը՝ կառավարության սահմանած կարգով: Կառավարության 2022 թ.-ի մարտի 24-ի «Տեղեկատվական տեխնոլոգիաների ոլորտի առևտրային կազմակերպություններին և անհատ ձեռնարկատերերին պետական աջակցության տրամադրման կարգը հաստատելու մասին» N 399-Լ և 2022 թ.-ի դեկտեմբերի 1-ի «Տեղեկատվական տեխնոլոգիաների ոլորտում գործունեություն իրականացնող առևտրային կազմակերպություններին և անհատ ձեռնարկատերերին պետական աջակցության տրամադրման կարգը հաստատելու մասին» N 1863-Լ որոշումներով սահմանված կարգավորումների համաձայն՝ նախարարությունը ՊԵԿ-ից ստանում է հարկ վճարողի կողմից ներկայացված հարկային հաշվարկներում արտացոլված, ՀՀ-ում կիրառվող՝ տնտեսական գործունեության տեսակների դասակարգչի կոդի և գործունեության տեսակների տեսակարար կշռի, աշխատողների թվաքանակի, նոր ընդունված աշխատողների վերաբերյալ հարկային մարմնի անձնավորված հաշվառման տեղեկատվական բազայում առկա տվյալների, գործատուի մոտ աշխատող չհանդիսանալու վերաբերյալ հարկային մարմնի անձնավորված հաշվառման տեղեկատվական բազայում առկա տվյալների, հաշվարկված և վճարված եկամտահարկի, հարկային մարմնի կողմից վերահսկվող եկամուտների գծով պարտավորությունների և եկամտահարկի գծով պարտավորություններն ամբողջությամբ կատարված լինելու վերաբերյալ տեղեկատվությունը:

ԲՏԱ նախարարությունն այս տեղեկատվությունը ներկայումս ստանում է իր կողմից ՊԵԿ-ին ուղղված դիմումների հիման վրա՝ յուրաքանչյուր դեպքի համար առանձին դիմում ներկայացնելու ձևով: Վերջին շրջանում պայմանավորված տեղեկատվական տեխնոլոգիաների ոլորտի զարգացման աճով, ոլորտի շահառուների ներկայացրած դիմումների քանակով և սահմանված ժամկետի սղությամբ՝ նախարարությունից պահանջվում է ժամանակ և ռեսուրսներ, ինչը հանգեցնում է խնդիրների: Ուստի անհրաժեշտ է, որ նախարարությունն ունենա հասանելիություն հարկային գաղտնիք կազմող տեղեկություններին, ինչը կնպաստի ոլորտում իրականացվող գործունեության արդյունավետության բարձրացմանը: Այս հարցի կարգավորմանն էլ ուղղված է նախագիծը:
