Երկու տարվա ընթացքում ինչ տեսակի նախաձեռնությունների ասես, որ ականատես չենք եղել։ Եվ շատ դեպքերում որոշ նախաձեռնություններ ուղղակի տեսարան ապահովելու կամ շոու մատուցելու նպատակ են հետապնդել։

Խնդիրը մեկն է՝ մշտապես զբաղեցնել մարդկանց, ցույց տալ, որ ահա փոփոխություններ կան երկրում, մեղավորները պատժվում են, պետությունից թալանված գումարները վերադարձվում են պետբյուջե և այլն։

Եթե մեկ տարի առաջ կարելի էր մարդկանց վրա տպավորություն գործել քրեական գործերի հարուցման մասին ոգեցունց հաղորդագրություններով, ապա այսօր քրեական գործերի հարուցման մասին տեղեկությունները դարձել են լրահոսի առօրյա մասը։ 

Իսկ քաղաքացիները շատ դեպքերում քրեական գործերի մասին լրահոսին անգամ հատուկ ուշադրություն չեն էլ դարձնում, քանի որ որոշ ժամանակ անց պարզվում է, որ այդ գործերի մեծ մասը կարճվել է համապատասխան ապացույցների բացակայության կամ հիմնավորված չլինելու պատճառով։

Քանի որ կորել է մարդկանց հետաքրքրությունը ընթացիկ քրեական գործերի մասով, ապա հնչեղ վերնագրերի սիրահար իշխանություններին նոր ինտրիգ է պետք։ Փաշինյանի ամբողջ գործունեությունը կապված է եղել լրագրությամբ շաղախված քաղաքական ինտրիգների հետ։ Իսկ ո՞րն է քաղաքական շոուի նոր սերիան։ 

Արդարադատության նախարարության հրապարակած օրենքների նախագծերից մեկում տեղեկանում ենք, որ, ոչ ավել, ոչ պակաս, որոշվել է ստեղծել փաստահավաք հանձնաժողով՝ 9 անդամով, որն ուսումնասիրելու է 1991 թվականից մինչև իշխանափոխությունն ընկած ժամանակաշրջանի իրավախախտումները։

Այսպիսի հանձնաժողով ստեղծելու գաղափարը նոր չէ, դրա մասին շատ անգամ է խոսել վարչապետ Փաշինյանը՝ հայտարարելով, թե նախորդ տարիների իրավախախտումները ջրի երես են դուրս բերելու։ 

Սակայն թեման անընդմեջ ներկայացվում էր անցումային արդարադատության ստեղծման համատեքստում, որն այդպես էլ մնաց անկատար։ 

Ու հետո անհասկանալի է, թե ի՞նչ իմաստ ունի առանձին հանձնաժողով ստեղծել ու հարկատուների գրպանից ֆինանսավորել դրա գործունեությունը, եթե իրավախախտումների մասով կարող են գործել իրավապահ մարմիններն ու դատարանները՝ մանավանդ երբ նախագծում արձանագրվում է, որ այս հանձնաժողովը չի լինելու արդարադատության մարմին, քրեական պատասխանատվություն չի սահմանելու, պատժամիջոցներ չի կիրառելու: 

Ըստ իշխանությունների՝ եթե հանձնաժողովականները ձեռք բերեն հետաքննության համար օգտակար ապացույցներ, ապա դրանք կարող են աջակցել դատարանների աշխատանքին: Եվ զարմանալի է, թե այդ ի՞նչ ապացույցներ ու փաստեր կարող են ձեռք բերել հանձնաժողովականները, որ չեն կարող ձեռք բերել իրավապահները։

Այնպես որ, հանրային օգտակարության տեսանկյունից Փաստահավաք հանձնաժողովի աշխատանքի օգտակարության մակարդակը չի կարող բարձր արդյունավետություն ապահովել։ Իսկ թե ինչո՞ւ իշխանափոխությունից հետո գրանցված իրավախախտումները չեն ուսումնասիրվելու, մնում է միայն կռահել։

Ինչպես ասում են, եթե ուզում ես որևէ հարց թաղես, հանձնաժողով ստեղծիր։ Այս դեպքը ևս բացառություն չէ։ Սույն հանձնաժողովն ուղղակի պետք է լրացուցիչ մահակ դառնա ընդդիմադիրների գլխավերևում, որպեսզի դրա միջոցով հնարավոր լինի կանխել վերջիններիս կողմից անցանկալի քննադատությունները և գործողությունները։
