Կենսաթոշակային ապահովության բնագավառում նոր կարգավորումներ են արվել

ՀՀ աշխատանքի և սոցիալական հարցերի նախարարությունը ներկայացրել է ՀՀ  կառավարության հոկտեմբերի 20-ի նիստում «Պետական կենuաթոշակների մաuին» օրենքում կիրարկման փոփոխությունները: ՀՀ աշխատանքի և սոցիալական հարցերի նախարարության հասարակայնության հետ կապերի բաժնից «Արմենպրես»-ին տրամադրված հայտարարության եջ ասվում է.

«ՀՀ  կառավարության 20.10.2016թ. հերթական նիստում ընդունված որոշման համաձայն  «Պետական կենuաթոշակների մաuին» Հայաuտանի Հանրապետության oրենքի կիրարկումն ապահովող ՀՀ կառավարության որոշման մեջ  կատարվել են փոփոխություններ և լրացումներ, որոնց համաձայն` մասնավորապես սահմանվել է. 

1. Ռազմական  ուսումնական հաստատությունում սովորող անձին, անկախ Հայաստանի Հանրապետությունում բնակության վայրի հասցեով հաշվառված լինելու հանգամանքից, կերակրողին կորցնելու դեպքում կենսաթոշակ նշանակում և վճարում է Սոցիալական ապահովության պետական  ծառայության  կենսաթոշակ նշանակող այն ստորաբաժանումը, որտեղ ներկայացվել են դիմումը և անհրաժեշտ փաստաթղթերը:  
Գործող կարգով  ռազմական ուսումնական հաստատությունում սովորող անձը կերակրողին կորցնելու դեպքում կենսաթոշակի նշանակման համար պետք է դիմի  անձամբ՝  իր հաշվառմա ն վայրի տարածքային բաժին:

2. Առաջին խմբի հաշմանդամին և ռազմական ուսումնական հաստատությունում սովորող անձին կենսաթոշակ նշանակելու գրավոր դիմումը և անհրաժեշտ փաստաթղթերը կարող է ներկայացնել նաև այլ անձ՝ լիազորագրի հիման վրա՝ ներկայացնելով նաև իր անձը հաստատող փաստաթուղթ: 

Գործող կարգով առաջին խմբի հաշմանդամը և ռազմական ուսումնական հաստատությունում սովորող անձը կենսաթոշակ նշանակելու գրավոր դիմումը պետք է ներկայացնեն անձամբ:

3. Սահմանվել է 2013 թվականի հունվարի 1-ից հետո ընկած ժամանակահատվածում քաղաքացիաիրավական պայմանագրերի շրջանակներում կատարվող աշխատանքներից, մատուցվող ծառայություններից եկամուտ ստանալու ժամանակահատվածն աշխատանքային ստաժում հաշվառելու կարգը:

4. Աշխատանքային ստաժը հաստատող արխիվային տվյալներն,  անհրաժեշտության դեպքում,  պետական արխիվից ստանում է Սոցիալական ապահովության պետական ծառայությունը՝ հարցման միջոցով:

Գործող կարգով՝ քաղաքացին անձամբ պետք է պետական արխիվից  ձեռք բերի արխիվային տվյալները և ներկայացնի տարածքային բաժին:  

5. Եթե կենսաթոշակի իրավունքն իրացնելու համար քաղաքացին պետք է ներկայացնի կենսաթոշակային ապահովության բնագավառում միջպետական համաձայնագիր կնքած մասնակից պետության համապատասխան մարմնի տված փաստաթուղթ, որը, սակայն, դիմումին կից չի ներկայացրել, ապա այդ փաստաթուղթը ստանալու համար անհրաժեշտ հարցումը տվյալ պետության իրավասու մարմին կատարում է Սոցիալական ապահովության պետական ծառայությունը: Ընդ որում, հետադարձով կենսաթոշակի գումարները վճարվում են անցած ամբողջ ժամանակահատվածի համար՝ քաղաքացու դիմելու օրվանից:

Գործող կարգով  տեղեկանքը ձեռք բերելու համար  միջպետական համաձայնագիր կնքած մասնակից պետության համապատասխան մարմին  քաղաքացին դիմում է անձամբ,  իսկ կենսաթոշակի իրավունքը իրացվում է ոչ թե դիմելու օրը,  այլ ՝ տեղեկանքը  տարածքային մարմին ներկայացնելու օրվանից»:
