ԱԺ-ն առաջին ընթերցմամբ ընդունեց պարտականությունները չկատարելու համար միակ կացարանից զրկելն արգելող օրենքի նախագիծը

Ազգային ժողովն առաջին ընթերցմամբ և միաձայն ընդունեց «Դատական ակտերի հարկադիր կատարման մասին» օրենքի նախագիծը և հարակից նախագծերի փաթեթը, որով առաջարկվում է անձին իր պարտականությունները չկատարելու համար չզրկել իր միակ կացարանից և դարձնել անօթևան՝ անկախ նրանից, թե ինչ պարտավորություն է նա խախտել: Ինչպես հաղորդում է «Արմենպրես»-ը, համապատասխան օրեն քի նախագծին կողմ քվեարկեց 102 պատգամավոր, դեմ և ձեռնպահ քվեարկողներ չեղան:
Օրենսդրական նախաձեռնության հիմնական նպատակն է ապահովել այն, որ մարդը, ինչ պարտավորություն էլ խախտել է, չմնա փողոցում, պարտականությունները չկատարելու համար պատասխան չտա իր բնակվելու իրավունքի հաշվին:
Այս կանոնից բացառություն են կազմում միայն այն դեպքերը, երբ միակ բնակարանը անձը՝ ի ապահովումն իր պարտավորությունների, գրավադրել է: Այսինքն, անձը կամավոր է պարտավորվել իր պարտավորությունների համար ռիսկի տակ դնել իր բնակվելու իրավունքը: Նախագիծը չի տարածվում նաև այն դեպքերի վրա, երբ անձը ալիմենտ վճարելու պարտավորություն ունի կամ պետք է հատուցի առողջությանը, կյանքին, հանցավորության պատճառով հասցրած վնասը: Սրանք են այն եզակի դեպքերը, երբ անձն իր պարտավորությունները կկատարի իր բնակվելու իրավունքի հաշվին:
ՀՀ սահմանադրությունը և միջազգային փաստաթղթերը մի կողմից նախատեսում են անձի սեփականության իրավունքը, մյուս կողմից էլ նախատեսվում է օրենքով սահմանել այդ սեփականության իրավունքի նկատմամբ սահմանափակումները:
ԴԱՀԿ մասին օրենքում նախատեսված է որոշակի գույքի ցանկ, որոնց նկատմամբ բռնագանձում չի կարող տարածվել: Դրանք են հաշմանդամների համար նախատեսված հատուկ փոխադրամիջոցները, պարտապանի մասնագիտական պարապմունքների համար անհրաժեշտ առարկաները: Օրենսդրական նախաձեռնությամբ առաջարկվում է այդ ցանկին ավելացնել, որ միակ բնակարանը և դրան կից հողամասը, որը պարտապանի համար հանդիսանում է մշտական բնակության միակ վայր և որի գնահատված արժեքի 75 տոկոսը հավասար կամ ցածր է ՀՀ կառավարության կողմից սահմանված միակ բնակարանի համար նախատեսված նվազագույն գումար ից, ևս չպետք է բռնագանձման ենթակա դառնա՝ բացառությամբ վերը նշված սահմանափակումների:
