ՀՀ Քրեական նոր օրենսգիրքը մշակող հանձնաժողովը ցանկանում է փոփոխություններ կատարել հանցակիցների պատասխանատվության վերաբերյալ այսօր գործող նորմերում

Հայաստանի Հանրապետության նոր քրեական օրենսգրքի հայեցակարգը մշակող հանձնաժողովը, ի թիվս օրենսգրքում մի շարք փոփոխություների, քննարկում է անզգուշությամբ հանցանքի համակատարման համապատճառման իրավիճակների օրենսդրական կարգավորումների հարցը, մասնավորապես՝ առաջարկվում է վերանայել Քրեական օրենսգրքի 39-րդ հոդվածը, որը վերաբերում է հանցակիցների պատասխանատվության հարցին:

Օրեր առաջ Քրեական օրենսգրքի հայեցակարգի վերաբերյալ քննարկման ժամանակ այս մասին ասաց հայեցակարգը մշակող հանձնաժողովի նախագահ, Երևանի պետական համալսարանի իրավագիտության ֆակուլտետի քրեական իրավունքի ամբիոնի վարիչ, իրավաբանական գիտությունների դոկտոր, պրոֆեսոր Արա Գաբուզյանը: Խոսքն ավելի մատչելի դարձնելու համար Գաբուզյանը ներկայացրեց կոնկրետ իրավիճակ: Ըստ պրոֆեսորի՝ օրինակ՝ երկու անձինք ինչ- որ բարձրությունից քարեր են նետում դեպի ներքև՝ ճանապարհի վրա՝ նախօրոք տեսնելով, որ ճանապարհով որևէ մեկը չի անցում, սակայն որոշ ժամանակ անց այդ նույն ճանապարհով մարդ է անցնում, որը վերևից նետված քարերից մեկի հարվածից մահանում է, ապա վերևից քարեր նետող երկու անձինք էլ պետք է անզգույշ մահ պատճառելու համար պատասխանատվության ենթարկվեն, քանի որ նրանց կատարած արարքը առաջացրել է ծանր հետևանք։

Գաբուզյանի խոսքով՝ չնայած հնարավոր չէ որոշել, թե վերևից քարեր նետող անձանցից հատկապես ում նետած քարի հարվածն է ճանապարհով անցնող անձին անզգույշ մահ պատճառել, այնուամենայնիվ, նրանք երկուսով են դիմել այդ գործողությանը, հետևաբար, միևնույն արարքի համար քրեական պատասխանատվության ենթակա են երկուսն էլ:

Past.am-ի ճշտող հարցին, այսինքն՝ ստացվում է, որ եթե անգամ հայտնի է, թե կոնկրետ ում նետած քարի հարվածն է առաջացրել մահ, վերևից քար նետող բոլոր անձինք նույն արարքի համար պետք է պատասխանատվությա՞ն ենթարկվեն, Գաբուզյանը դրական պատասպան տվեց:

«Այդ ծանր հետևանքն առաջացել է նրանց երկուսի համատեղ կատարած գործողությունների արդյունքում»,- ասաց Գաբուզյանը՝ բացատրելով, որ միայն պատահականության հետևանք է, որ ճանապարհով անցնող անձին անզգույշ մահ է պատճառել վերևից քարեր նետող անձանցից մեկի նետած քարի հարվածը:

Նշենք, որ այս տեսակետը միանշանակ չի ընդունվում իրավական ոլորտի մասնագետների կողմից. ոմանք կարծում են, որ պետք է փոփոխություններ չմտցնել իրական այս կարգավորման մեջ և այն պետք է թողնել այն տեսքով, որը հիմա գործում է։
