Դատական համակարգի բարեփոխման առումով սահմանադրական փոփոխությունների նախագիծն ի՞նչ կտա մեզ: Այս և այլ հարցերի շուրջ Past.am-ը զրուցել է «Սարգսյան իրավաբանական խումբ» իրավաբանական միավորման ղեկավար Տիգրան Սարգսյանի հետ:
- Պարոն Սարգսյան, որքանո՞վ են կարևորվում դատական համակարգում նախատեսվող փոփոխությունները: Ի՞նչ կտա այն մեր հասարակությանը:
- Սահմանադրությամբ ամրագրված ամենաբարձր արժեքներն անգամ ոչինչ են, եթե մենք չունենք արդարադատություն: Ցանկացած դատական համակարգ չէ, որ ունակ է ապահովել արդարադատության իրականացումը: Սահմանադրական փոփոխությունների նախագծով փորձ է արվում դատական համակարգի բարեփոխման իմիտացիա անել:
-Ի՞նչ իմիտացիայի մասին է խոսքը: Չկա՞ որևէ էական փոփոխություն:
-Չնայած դատական համակարգում առկա խորը ճգնաժամին՝ նախագծով ոչինչ չի արվել իրականությունը փոխելու համար: Բարձրագույն դատական խորհրդի և Վճռաբեկ դատարանի ձևավորմանը Ազգային ժողովի մասնակցությունը ներկայացվում է որպես բարեփոխում: Իրականում, եթե ցանկանում ենք դատական համակարգում բարեփոխում ունենալ, ապա պետք է սահմանադրական մեխանիզմներ նախատեսենք դատական իշխանության նկատմամբ հասարակական վերահսկողություն իրականացնելու համար, ինչը նախատեսված չէ նախագծում:
-Ինչպե՞ս կարելի է նվաճել անկախ, անկողմնակալ և պրոֆեսիոնալ դատական համակագ ունենալու իրավունքը:
-Սա միայն սահմանադրական կամ օրենսդրական լուծում պահանջող հարց չէ: Առաջին հերթին անհրաժեշտ է իրավունքների համար փաստաբանների միջոցով դատական ատյաններում ակտիվ պայքարող քաղաքացիներ ունենալ: Երբ քաղաքացին փաստաբանի օգնությամբ իրավունքի դաշտում կհաղթի ոչ պրոֆեսիոնալ դատավորին, քաղաքական իշխանությունը դատական համակարգի համար բարեփոխման հրահանգ կիջեցնի: Դատական համակարգում առկա բազմաթիվ խնդիրների լուծման միակ ուղին ապօրինի դատական ակտերի համատարած բողոքարկումն է Եվրոպական դատարանում:
