ԵԽ-ն շարունակելու է ջանքերը Հայաստանում արդարադատության համակարգի զարգացման գործում

Եվրոպական միության և Եվրոպայի խորհդի համատեղ դեկտեմբերի 7-ին տեղի ունեցավ  «Հայաստանի արդարարադատության համակարգի անկախության, պրոֆեսիոնալիզմի և հաշվետվողականության ամրապնդումը» ծրագրի փակման արարարողությունը: Միջոցառմանը ներկա էին Հայաստանում Եվրամիության պատվիրակության ղեկավար, դեսպան  Պյոտր Սվիտալսկին, Եվրոպայի խորհրդի մարդու իրավունքների և իրավունքի գերակայության տնօրինության արդարադատության և իրավական համագործակցության վարչության ղեկավար Հաննե Յունկերը, ՀՀ սահմանադրական դատարանի նախագահ Գագիկ Հարությունյանը, Հայաստանի և Եվրոպայի խորհրդի այլ բարձրաստիճան պաշտոնյաներ:

Ինչպես տեղեկացնում է «Արմենպրես»-ը, Հաննե Յունքերը բացման իր խոսքում շնորհակալություն հայտնեց ծրագրի բոլոր շահառուներին, ինչպես նաև ԵՄ պատվիրակությանը` մշտական աջակցության և արդյունավետ համագործակցության համար:

«Ծրագիրը հասել է նշանակալի և շոշափելի արդյունքների, և Եվրոպայի խորհուրդը շարունակում է իր ջանքերն ու հանձնառությունը` ամրապնդելու Հայաստանի արդարադատության ոլորտի հաստատված հայեցակարգերն ու մեկնարկած գործընթացները»,- շեշտեց նա:

Իրագործման 31 ամիսների ընթացքում այս համատեղ ծրագիրը ՀՀ իրավական և դատական բարեփոխումների 2012-16 թվականների ռազմավարական ծրագրի շրջանակներում Հայաստանին տրամադրվել է տեխնիկական և փորձագիտական աջակցություն:

2014 թվականի հունիսից ի վեր ծրագրի շրջանակներում տրամադրվել է օժանդակություն իրավական ակտերի մշակման հարցում, ինպես նաև ինստիտուցիոնալ և կարողությունների զարգացմանն ուղված աջակցություն ՀՀ արդարադատության նախարարությանը, դատական իշխանությանը, արդարադատության ակադեմիային և փաստաբանական դպրոցին, ինչպես նաև այլ ազգային շահառուներին:

Ծրագրի շրջանակներում մշակվել կամ լրամշակվել են առանցքային այնպիսի իրավական ակտեր, ինչպիսիք են ՀՀ քաղաքացիական դատավարության օրենսգիրքը, «Սնանկության մասին» և «Առևտրային արբիտրաժի մասին» օրենքները: Բարելավվել են դատական համակարգի հաշվետվողականության համակարգը և ընթացակարգերը, ինպես նաև Հայաստանում ներդրվել է հաշտարարության ինստիտուտը:

Գագիկ Հարությունյանը իր խոսքում կարևորեց դատական իշխանության անկախությունը և իրավունքի գերակայությանը սկբունքը Հայաստանում:

«Այս սկզբունքի վերաբերյալ պատկերացումները, ցավոք, միշտ չէ, որ ճիշտ են: Ուստի պետք է իրավունքի գերակայությունը դառնա յուրաքանչյուր քաղաքացու սոցիալական, քաղաքական, պետական վարքագծի հենքը»,- ընդգծեց Հարությունյանը:

 ՀՀ սահմանադրական դատարանի նախագահն ասաց, որ ծրագրի փակումը դեռ գործի ավարտը չէ և պետք է  նոր մոտեցմամբ և առաջարկություններով լուծել այն խնդիրները, որոնք առկա են դատաիրավական համակարգում:
