Բարեփոխվում է պատժից պայմանական վաղաժամկետ ազատելու համակարգը

ՀՀ Նախագահի կարգադրությանը համահունչ բարեփոխվում է պատժից պայմանական վաղաժամկետ ազատելու, պատժի չկրած մասն ավելի մեղմ պատժատեսակով փոխարինելու ընթացակարգը: ՀՀ կառավարության նիստում այս մասին դեկտեմբերի 29-ին հայտարարեց արդարադատության նախարար Արփինե Հովհաննիսյանը:  Նրա խոսքով, մասնավորապես, առաջարկվում է գործարկել անկախ հանձնաժողով-դա տարան ինստիտուցիոնալ մոդելը՝ օժտված համապատասխան գործիքակազմով: Այս մասին «Արմենպրես»-ին տեղեկացրին ՀՀ արդարադատության նախարարության տեղեկատվության և հասարակայնության հետ կապերի վարչությունից:

«Այս մոդելը կբացառի պատիժը կատարող հիմնարկի և անկախ հանձնաժողովի կողմից նույնաբնույթ գործառույթների իրականացումը, կբարձրացնի անկախ հանձնաժողովների արդյունավետությունը»,- նշեց նախարարը:

Արփինե Հովհաննիսյանն ընդգծեց, որ կսահմանվեն հստակ չափանիշներ, որոնք կդրվեն և՛ անկախ հանձնաժողովի, և՛ դատարանի՝ պատժից պայմանական վաղաժամկետ ազատելու, պատժի չկրած մասն ավելի մեղմ պատժատեսակով փոխարինելու վերաբերյալ պատճառաբանված որոշումների հիմքում: «Ընտրվել են հնարավորինս օբյեկտիվ և չափելի գործոններ, որոնք կարող են նվազագույնի հասցնել չափանիշները գնահատողի սուբյեկտիվիզմը»,- վստահեցրեց նախարարը:

Առաջարկվող կարգավորմամբ դատապարտյալն իրավունք կունենա մասնակցելու իրեն վերաբերող որոշումների կայացմանը և իրականացնելու համապատասխան պաշտպանություն, այդ թվում՝ ըստ էության բողոքարկելով անկախ հանձնաժողովի որոշումները: Սա բխում է դատապարտյալի լսված լինելու և դատական պաշտպանության սկզբունքներից: Փոփոխության է ենթարկվելու նաև անկախ հանձնաժողովի կազմում ընդգրկվող ներկայացուցիչների կազմը: Մասնավորապես՝ անկախ հանձնաժողովի կազմում կընդգրկվեն ներկայացուցիչներ ՀՀ արդարադատության, առողջապահության, աշխատանքի և սոցիալական հարցերի նա խարարություններից, ՀՀ Նախագահի, Մարդու իրավունքների պաշտպանի աշխատակազմերից, ՀՀ փաստաբանների պալատից և հասարակական կազմակերպությունից:
