Ի՞նչ սպասել իրավական համակարգում 2017-ին՝ ըստ փաստաբանի
INTERVIEW
Past.am-ը տարին ամփոփել է իրավաբան Տիգրան Սարգսյանի հետ:
-Պարոն Սարգսյան, ավարտվում է 2016 թվականը, մենք կարողացա՞նք առավել մոտենալ իրավական պետություն ունենալու մեր ձգտումներին:
-Իրականում, իրավական պետություն ունենալու համար ստիպված ենք առավել կտրուկ քայլերի գնալ: Սկզբունքային փոփոխություններ են անհրաժեշտ իրավապահ համակարգում, դատարաններում և ազատազրկման վայրերում:
-Ի՞նչ փոփոխություններ նկատի ունեք: Հնարավո՞ր է դրանք իրականացնել 2017 թվականի ընթացքում:
-Իրավական պետություն ունենելու կարևոր պայման է հասարակության վստահությունը և հավատը դատարանների նկատմամաբ: 2017 թվականի թիվ մեկ խնդիրը շարունակելու է մնալ դատական համակարգի բարեփոխումը: 2017–ին է ձևավորվելու է պառլամենտը, որը, ըստ փոփոխված սահմանադրության, պետք է ձևավորի բարձրագույն դատական ատյանները: Հասարակությունը որակյալ պառլամենտ ձևավորելու դեպքում կկարողանա նաև ազատվել այսօրվա վատ դատական համակարգից:
-Այնպիսի տպավորություն է, որ մեկ անգամ հանցանք կատարած և ազատազրկման դատապարտված անձը կրկին վերադառնում է բանտ: Որքանո՞վ է սա իրականությանը համապատասխան:
-Ցավոք, չունենք դատապարտյալներին ուղղելու և հասարակություն վերադարձնելու արդյունավետ մեխանիզմներ: Այս ոլորտում հսկսյական անելիքներ կան, պետությունը չունի հստակ մշակած ծրագիր, որով կկարողանա ուղղել մեկ անգամ հանցանք կատարած անձին և նրա մեջ ձևավորել օրինականության մշակույթ:
-Ի՞նչ եք ցանկանում մաղթել հայ ժողովրդին գալիք Ամանարի կապակցությամբ:
-Հայ ժողովորդին ցանկանում եմ միասնություն, լավատեսություն, պայքարելու և արարելու անկոտրում ոգի:
