Ավարտվել է ԴԱՀԿ չորս աշխատակցի կողմից պաշտոնեական կեղծիք կատարելու գործով նախաքննությունը

Կեղծ պաշտոնական փաստաթուղթ կազմելու դեպքի առթիվ ՀՀ հատուկ քննչական ծառայությունում հարուցված քրեական գործի նախաքննության արդյունքում ձեռք բերված բավարար ապացույցներով հիմնավորվել է, որ ՀՀ ԱՆ հարկադիր կատարման ծառայության աշխատակիցները կազմել են կեղծ պաշտոնական փաստաթուղթ` թաքցնելով իրականությունը: Այս մասին «Արմենպրես»-ին տեղեկացրին ՀՔԾ լրատվական ծառայությունից:
Մասնավորապես, նախաքննության արդյունքում բացահայտվել է, որ դեռևս 2015թ.–ին դատարանի կողմից վճիռ էր կայացվել Ն.Հակոբյանին և վերջինիս որդիներին Երևանի Գուլակյան փողոցի թիվ 27/1 հասցեում գտնվող տան բակային տարածքից և օժանդակ շինությունից վտարելու մասին: Դատարանի վճռի հիման վրա ԴԱՀԿ ծառայության կենտրոնական մարմնի հարկադիր կատարման օպերատիվ բաժնի պետի տեղակալ Գ. Հովհաննիսյանը և նույն բաժնի աշխատակիցներ Ս. Յարալյանը, Վ. Մելիքբեկյանն ու Ա.Իսրայելյանը 10.11.2015թ.-ին Ն. Հակոբյանին և նրա որդիներին վտարել են հիշյալ հասցեի տարածքից: Վտարման գործ ողությունների ժամանակ բանվորական ուժի միջոցով քարե պատ է շարվել Ն. Հակոբյանի տան միակ մուտքի դռան դիմաց և երկաթյա ճաղավանդակ տեղադրվել տան պատուհանին՝ այդպիսով վերջինիս զրկելով տուն մուտք գործելու հնարավորությունից: Սակայն հիշյալ հանգամանքը թաքցնելու նպատակով` Ս. Յարալյանը Գ. Հովհաննիսյանի, Ա. Իսրայելյանի և Վ. Մելիքբեկյանի մասնակցությամբ կազմել է կատարողական գործողությունների վերաբերյալ արձանագրություն, որում ներառվել են իրականությանը չհամապատասխանող ակնհայտ կեղծ տեղեկություններ, այսինքն` ԴԱՀԿ աշխատակիցներն այդ արձանագրութ յունում նշել են, թե, իբր, Ն. Հակոբյանի տուն հնարավոր է մուտք գործել նաև կառույցի հետնամասից այն դեպքում, երբ վերջինիս տուն տանող որևէ մուտք իրականում առկա չի եղել:
Այսպիսով, կեղծ պաշտոնական փաստաթուղթ կազմելու համար ՀՀ քրեական օրենսգրքի 314-րդ հոդվածի 1-ին մասով մեղադրանքներ են առաջադրվել Գ. Հովհաննիսյանին, Ս. Յարալյանին, Վ. Մելիքբեկյանին ու Ա. Իսրայելյանին: Քրեական գործի նախաքննությունն ավարտվել է: Գործը մեղադրական եզրակացությամբ հանձնվել է դատավարական հսկողություն իրականացնող դատախազին` այն հաստատելու և դատարան ուղարկելու համար:
Ծանուցում. ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
