 ՀՀ քննչական կոմիտեի ՀԿԳ քննության գլխավոր վարչությունում քննվող քրեական գործով ձեռնարկված քննչական գործողությունների արդյունքում բացահայտվել են 2016թ. փետրվարին Դիլիջան քաղաքում տեղի ունեցած զինված միջադեպի՝ էական նշանակություն ունեցող մի շարք հանգամանքեր: Այս մասին «Արմենպրես»-ին տեղեկացրին ՀՀ քննչական կոմիտեի դեպարտամենտի տեղ եկատվության և հասարակայնության հետ կապերի բաժնից:

2016թ. փետրվարի 11-ին ահազանգ էր ստացվել, որ Դիլիջան քաղաքի Թբիլիսյան խճուղում հնչել են կրակոցներ, որոնց հետևանքով 1989թ. ծնված Ս.Միքայելյանը հրազենային վնասվածքով տեղափոխվել է բժշկական կենտրոն։ 

Սպանության փորձի դեպքի առթիվ հարուցվել է քրեական գործ, որով նախաքննությունն իրականացվել է ՀՀ ՔԿ ՀԿԳ քննության գլխավոր վարչության վարույթում։  Ձեռնարկված քննչական մեծածավալ գործողությունների արդյունքում բացահայտվել են էական նշանակություն ունեցող մի շարք հանգամանքներ, այդ թվում՝ միջադեպին մասնակից անձանց շրջանակը, անհատականացվել նրանց գործողությունները, պարզվել վիճաբանության շարժառիթը։ 

Մասնավորապես ՝փաստական տվյալներ են ձեռք բերվել առ այն, որ Դիլիջան քաղաքի երկու բնակիչներ՝ Դ.Հակոբյանը և Ս.Միքայելյանը, դեպքից օրեր առաջ՝ փետրվարի 9-ին, կենցաղային հարցերի շուրջ վիճաբանել են Դիլիջան քաղաքում գործող ավտոլվացման կետի մոտ։  Չպարզաբանված հարցերի շուրջ զրուցելու համար կողմերը նախնական պայմանավորվել են հանդիպել փետրվարի 11-ին՝ առանց հստակեցնելու ժամը և հանդիպման վայրը։

 Նախնական քննության տվյալներով՝ դեպքի օրը Ս.Միքայելյանն իր անձնական ավտոմեքենայով, որի ղեկին գտնվել է ընկերը,  մի քանի անգամ գնացել է Դ.Հակոբյանի բնակության վայր՝ Շամախյան թաղամաս։ Հերթական այցը տեղի է ունեցել ժամը 22-ի սահմաններում, որտեղից վերադառնալիս  Դ.Հակոբյանի կողմից կրակոցներ են արձակվել Ս.Միքայելյանի ավտոմեքենայի ուղղությամբ, որոնք դիպել են ավտոմեքենայի տարբեր մասերին։ Միջադեպի հետևանքով Ս.Միքայելյանն ստացել է տարբեր վնասվածքներ՝ աջ սրունքի վերին երրորդականի հրազենային գնդակային վիրավորման, ազդրի, ծնկահոդի և սրու նքի շրջանի բազմաթիվ սալջարդ վերքերի ձևով:

Քննությամբ բավարար ապացույցներ են ձեռք բերվել, որ ինքնաձիգ և մարտական փամփուշտներ են եղել  նաև Ս.Միքայելյանի ավտոմեքենայում, ով իր ավտոմեքենայի ուղղությամբ արձակված կրակոցներից հետո ինքնաձիգից կրակոցներ է արձակել օդ՝ վախեցնելու նպատակով և դիմել փախուստի:

Ձեռք բերված ապացույցների հիման վրա՝ Դ.Հակոբյանին մեղադրանք է առաջադրվել՝ ՀՀ քրեական օրենսգրքի 34-104-րդ հոդվածի 2-րդ մասի 6-րդ կետով և 235-րդ հոդվածի 1-ին մասով:

Առանձին քրեական գործ է հարուցվել նաև՝ Ս.Միքայելյանի կողմից ապօրինի զենք և ռազմամթերք ձեռք բերելու և պահելու համար, և տվյալ քրեական գործի շրջանակներում մեղադրանք է առաջադրվել նաև նրան՝ ՀՀ քրեական օրենսգրքի 235-րդ հոդվածի 1-ին մասով: 

Երկու քրեական գործերով նախաքննությունն ավարտվել է և մեղադրական եզրակացությամբ ուղարկվել նախաքննության օրինականության նկատմամբ հսկողություն իրականացնող դատախազին:

Ծանուցում. Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
