Երևանի թիվ 195 դպրոցում անչափահասի դանակահարության դեպքով մեղադրանք է առաջադրվել. գործը դատարանում է

ՀՀ քննչական կոմիտեի Երևան քաղաքի Աջափնյակ և Դավթաշեն վարչական շրջանների քննչական բաժնում ավարտվել է անչափահասներին կտրող-ծակող առարկայով մարմնական վնաս պատճառելու դեպքի առթիվ հարուցված քրեական գործի նախաքննությունը:
Այս մասին հայտնում են ՀՀ քննչական կոմիտեի դեպարտամենտի տեղեկատվության և հասարակայնության հետ կապերի բաժնից։
Նախաքննության ընթացքում ձեռնարկված քննչական և դատավարական գործողությունների արդյունքում պարզվել է, որ անչափահասները վնասվածքներն ստացել են 2015 թվականի փետրվարի 22-ին՝ ժամը 19:00-ի սահմաններում, Երևան քաղաքի թիվ 195 դպրոցի մոտ տեղի ունեցած վիճաբանության ժամանակ։
Պարզվել է նաև առերևույթ հանցագործություն կատարած անձի ինքնությունը, ով նույնպես անչափահաս է։
Նախաքննությամբ ձեռք բերված ապացույցների համաձայն՝ 2015 թվականի փետրվարի 22-ին` ժամը 19:00-ի սահմաններում, անչափահաս Աբովյանը Երևան քաղաքի Մազմանյան և Բաշինջաղյան փողոցների խաչմերուկում հանդիպել է իր ծանոթին, ով զանգահարելու համար խնդրել է տրամադրել իր բջջային հեռախոսը:
Հեռախոսով զրուցելով քայլել են դեպի թիվ 195 դպրոցի բակ, որտեղ հանդիպել են այլ ծանոթ անձանց: Առաջացել է վիճաբանություն, որի ժամանակ երկու անչափահասի՝ Նիկողոսյանին և Սահակյանին, պատճառվել են մարմնական վնասվածքներ։ Նիկողոսյանի կրծքավանդակի ձախ հատվածին կտրող-ծակող առարկայով պատճառված մարմնական վնասվածքը դատաբժշկական փորձաքննության եզրակացությամբ գնահատվել է ծանր, իսկ Սահակյանի վնասվածքը՝ միջին ծանրության:
Նախաքննության ընթացքում տուժող Սահակյանը բողոք չի ներկայացրել։ Նկատի ունենալով, որ ՀՀ քրեական դատավարության օրենսգրքի 183-րդ հոդվածի համաձայն՝ միջին ծանրության մարմնական վնասվածք պատճառելու համար գործերը հարուցվում են ոչ այլ կերպ, քան տուժողի բողոքի հիման վրա, ուստիև` 2015 թվականի մարտի 19-ին որոշում է կայացվել Վ. Սահակյանի առողջությանը դիտավորությամբ միջին ծանրության մարմնական վնասվածք պատճառելու դեպքի առթիվ Աբովյանի նկատմամբ քրեական հետապնդում չիրականացնել` դիմողի բողոքի բացակայության հիմքով:
Մինչդատական վարույթի ընթացքում ձեռք բերված ապացույցների հիման վրա Աբովյանին մեղադրանք է առաջադրվել` Նիկողոսյանին ծանր մարմնական վնաս պատճառելու համար՝ ՀՀ քրեական օրենսգրքի 112-րդ հոդվածի 1-ին մասով: Նրա նկատմամբ խափանման միջոց է ընտրվել ծնողի հսկողությանը հանձնելը:
Քրեական գործը՝ մեղադրական եզրակացությամբ, ուղարկվել է նախաքննության օրինականության նկատմամբ հսկողություն իրականացնող դատախազին, մեղադրական եզրակացությունը հաստատվել է, և գործն ուղարկվել Երևան քաղաքի Աջափնյակ և Դավթաշեն վարչական շրջանների ընդհանուր իրավասության դատարան:
