Հայաստանն ամենաբարձր` Սահմանադրական կարգով արգելել է խոշտանգումը

Միջազգային իրավական պրակտիկայում խոշտանգումների և վատ վերաբերմունքի արգելքն ունի բացարձակ բնույթ և այս կանոնից թույլատրված չէ որևէ բացառություն: «Աջակցություն Հայաստանում քրեական արդարադատության համակարգի բարեփոխումներին և պայքար վատ վերաբերմունքի և անպատժելիության դեմ» ծրագրի մեկնարկին այս մասին նշեց ՀՀ գլխավոր դատախազ Գևորգ Կոստանյանը: «Հայաստանի Հանրապետությունն այն երկրներից է, որ ամենաբարձր` Սահմանադրական կարգով արգելել է խոշտանգումը կամ դրա որևէ դրսևրում: Խոշտանգման բացարձակ արգելքներ սահմանված են նաև ՀՀ քրեական դատավարության օրենսգրքում և մի շարք այլ օրենսդրական ակտերում: Իհարկե, ցանկացած օրենսդրական բարեփոխում դատապարտված է անհաջողության, եթե չի ապահովվում բարեփոխված օրենսդրական դրույթների լիարժեք և ճիշտ կիրառությունն իրական կյանքում: Այդ իսկ պատճառով մեր երկրում պետք է որդեգրել այնպիսի քաղաքականություն, որը կապահովի վատ վերաբերմունքի տարբեր ձևերի արգելքի պրակտիկ և իրական կիրառությունը, և այս տեսանկյունից կարևոր նշանակություն ունի խոշտանգումների դեպքերի հայտնաբերումը և դրանց կապակցությամբ արդյունավետ քննության իրականացումը»,-նշեց նա` հավելելով, որ այս խնդրի լուծումը կարևոր է նաև երկրում արդարադատության պատշաճ իրականացումն ապահովելու առումով:
ՀՀ արդարադատության նախարար Արփինե Հովհաննիսյանը նկատեց, որ Հայաստանը մշտապես կարևորել է մարդու իրավունքների եվրոպական չափանիշների կիրառումը և դրանց կիրառության հարցում անհրաժեշտ մեխանիզմների առկայությունը: «Այս ծրագիրն օժանդակելու է քրեական օրենսդրության, ինչպես նաև վատ վերաբերմունքի դեպքերի դեմ պայքարի ինստիտուցիոնալ մեխանիզմների բարելավմանը: Այս առումով շատ եմ կարևորում ՀՀ նոր քրեական և քրեադատավարական օրենսգրքերի նախագծերի ընդունումը, որը հստակեցնելու է դատավորների, դատախազների և քննիչների պատասխանատվությունը խ ոշտանգումների դեպքում»,-ընդգծեց նա:
«Աջակցություն Հայաստանում քրեական արդարադատության համակարգի բարեփոխումներին և պայքար վատ վերաբերմունքի և անպատժելիության դեմ» ծրագրի ընդհանուր բյուջեն կազմում է 500 հազար եվրո, որը կազմում է Եվրամիության և Եվրոպայի խորհրդի Արևելյան գործընկերության 2015-2017 թվականների ծրագրային համագործակցության կառուցակարգի մի մասը(այս ծրագիրը անցկացվում է Արևելյան գործընկերության վեց պետություններում` 33,8 միլիոն եվրո ընդհանուր արժողությամբ բյուջեով):
