Կառավարությունը հաստատել է կամավորական գործունեությունը կանոնակարգող հայեցակարգը

ՀՀ աշխատանքի և սոցիալական հարցերի նախարար Արտեմ Ասատրյանի ներկայացմամբ ՀՀ կառավարության հերթական նիստում հավանության է արժանացել «Կամավորական գործունեության և կամավոր աշխատանքի մասին» ՀՀ օրենքի հայեցակարգը: Այս մասին «Արմենպրես»-ին տեղեկացրին ՀՀ աշխատանքի և սոցիալական հարցերի նախարարության հասարակայնության հետ կապերի բաժնից:
ՀՀ աշխատանքային օրենսգրքի համաձայն՝ կամավոր աշխատանքը և օգնություն ցուցաբերելու նպատակով կատարված աշխատանքը չեն կարող համարվել անօրինական, այդ աշխատանքների կատարման կարգն ու պայմանները պետք է սահմանվեն օրենքով:
Կամավորական գործունեության և կամավոր աշխատանքի հետ կապված որոշ հարաբերություններ ներկայումս կարգավորված են «Բարեգործության մասին» ՀՀ օրենքով. սահմանված է «կամավորի» հասկացությունը, կամավորներ ներգրավելու իրավասություն ունեցող կազմակերպությունների շրջանակը:
Սակայն, դեռևս առկա են օրենքով կարգավորման ենթակա խնդիրներ, որոնք կարող են խոչընդոտել ոլորտի կայացմանն ու հետագա զարգացմանը:
Խնդիրների լուծումներն ապահովելու և կամավորական գործունեության խթանիչ կարգավորումները նախատեսելու համար նախագծով առաջարկվում է ՝
1. կամավորի հաշվառման մեխանիզմների ներդրումը, որը հնարավորություն կտա՝
ա. երիտասարդ կամավորին ձեռք բերել աշխատաշուկայում արդյունավետ ինտեգրման համար անհրաժեշտ մասնագիտական փորձ ու լրացուցիչ հմտություններ, և դա հետագայում կիրառելի դարձնել աշխատանքի տեղավորման նպատակով,
բ. շահագրգիռ կողմերին տրամադրել կամավորների մասին դասակարգված և համակարգված տեղեկատվություն, որը գործնականում կխթանի կամավորական աշխատանքի կազմակերպման գործընթացները,
2. կամավորական գործունեության մշտադիտարկման համակարգի ձևավորումը՝ իրավակիրառական պրակտիկայից բխող խնդիրները հետևողական վեր հանելու և անհրաժեշտ լուծումներն ապահովելու նպատակով,
3. կամավորներին և կամավորական կազմակերպություններին պետական աջակցության տրամադրումը՝ կազմակերպչական, տեղեկատվական, մեթոդական և խորհրդատվական ապահովման ուղղություններով,
4. կամավորի դերի հետևողական բարձրացման նպատակով՝ կամավորի պարգևատրումը, խրախուսումը և նմանատիպ այլ միջոցառումների իրականացումը:
Նախագծի մշակումը բխում է ՀՀ կառավարության գործունեության ծրագրից, ըստ որի՝ նախատեսված է օրենքով լիարժեք կարգավորել կամավորական գործունեության և կամավոր աշխատանք կատարելու հետ կապված հարաբերությունները:
