Armtimes / ՀՀ կառավարության այսօրվա նիստում սփյուռքի նախարար Հրանուշ Հակոբյանը որպես չզեկուցվող հարց գործադրին է ներկայացրել կառավարության դրական եզրակացությունը Ազգային ժողովի Հայ ազգային կոնգրես խմբակցության պատգամավոր Արամ Մանուկյանի հեղինակած օրենսդրական նախաձեռնության վերաբերյալ:

«Հավանություն տալ «Սահմանված կարգի խախտմամբ պարտադիր զինվորական ծառայություն չանցած քաղաքացիների մասին» ՀՀ օրենքում փոփոխություն կատարելու մասին» ՀՀ օրենքի նախագծի վերաբերյալ ՀՀ կառա­վա­­րու­թյան եզրակացության նախագծին և այն սահմանված կար­գով ներկայացնել Ազգային ժողով»,- նշված է կառավարության արձանագրային որոշման նախագծում:

Արամ Մանուկյանն այս տարվա փետրվարի 28-ին ԱԺ-ում շրջանառության մեջ է դրել «Սահմանված կարգի խախտմամբ պարտադիր զինվորական ծառայություն չանցած քաղաքացիների մասին» ՀՀ օրենքում փոփոխություն կատարելու մասին օրենսդրական նախագիծը: Պատգամավորն առաջարկում է «Սահմանված կարգի խախտմամբ պարտադիր զինվորական ծառայություն չանցած քաղաքացիների մասին» օրենքի 1-ին հոդվածում «2009 թվականի մայիսի 1-ն» բառերը փոխարինել «2017 թվականի մայիսի 1-ն» բառերով:

Ըստ Արամ Մանուկյանի հիմնավորման, «Զինապարտության մասին» օրենքի խախտմամբ պարտադիր զինվորական ծառայության զորակոչից խուսափած ու 27 տարին լրացած ՀՀ քաղաքացիները, խուսափելով քրեական հետապնդումից, չեն վերադառնում հայրենիք: Այդ քաղաքացիների նկատմամբ հարուցված քրեական հետապնդումը դադարեցնելու նպատակով արդեն մի քանի անգամ կատարվել է փոփոխություն, որը մեծ խթան է հանդիսացել հազարավոր երիտասարդների վերադարձը Հայրենիք ապահովելու գործում:

Օրենքի ընդունմամբ ակնկալվում է, որ «Սահմանված կարգի խախտմամբ պարտադիր զինվորական ծառայություն չանցած քաղաքացիների մասին» օրենքի գործողության ժամկետի երկարաձգումը հնարավորություն է տալիս 27 տարին լրացած, պարտադիր զինվորական ծառայությունից խուսափած քաղաքացիներին սահմանված ժամկետում մուծել համապատասխան վճարը, վերադառնալ հայրենիք եւ ազատվել քրեական հետապնդումից:

Ըստ Ազգային ժողովի աշխատակազմի իրավաբանական վարչության մարտի 7-ի եզրակացության՝ նախագիծը չի հակասում Սահմանադրությանը, միջազգային իրավունքի սկզբունքներին եւ նորմերին, ՀՀ-ի վավերացրած միջազգային պայմանագրերին եւ ՀՀ օրենքներին: Վարչությունը, սակայն տեխնիկական խնդիրներ է գտել պատգամավորի ներկայացրած նախագծում: «Օրենսդրական տեխնիկայի կանոններին համապատասխանության տեսանկյունից նշենք հետեւյալը` … առաջարկվում է «2009 թվականի մայիսի 1-ն» բառերը փոխարինել «2017 թվականի մայիսի 1-ն» բառերով, մինչդեռ օրենքի 1-ին հոդվածում «2009 թվականի մայիսի 1-ն» բառեր գոյություն չունեն: Այդ առումով նախագծով առաջարկվող փոփոխությունը վերանայման կարիք ունի: Նախագծի վերաբերյալ այլ դիտողություններ եւ առաջարկություններ չկան»,- ասված է վարչության եզրակացության մեջ:

Նշենք, որ գործող օրենքի 1-ին հոդվածում վիճահարույց բառերը «2012 թվականի նոյեմբերի 1-ն» բառերն են:

Ազգային ժողովի պաշտոնական կայքից էլ տեղեկանում ենք, որ այս նախագիծը դեռեւս ներառված չէ ԱԺ առաջիկա նստաշրջանի օրակարգում:
