Պետական մարմինները տեղեկատվության ոլորոտում պարտականությունները չկատարելու դեպքում կենթարկվեն վարչական պատասխանատվության

«Տեղեկատվության ազատության մասի» ՀՀ օրենքում սպասվող փոփոխություններով պետական մարմինները տեղեկատվության ազատության ոլորոտում իրենց պարտականությունները չկատարելու դեպքում կենթարկվեն վարչական պատասխանատվության: Այս մասին «Արմենպրես»-ի մամուլի սրահում հրավիրված ասուլիսում նշեց ՀՀ արդարադատության նախարարի տեղակալ Սուր են Քրմոյանը:
«Մենք կարծում ենք, որ պետական մարմինների, քաղաքացու, հասարակական կազմակերպությունների համար շատ կարևոր է, որ պետությունը հրապարակի համապատասան տեղեկատվություն: Դրանով նախ թեթևացվում է պետական մարմինների բեռը, որ ավելորդ հարցումներ չստանան, երկրորդը` դա քաղաքացիների հանդեպ հաշվետվողականություն է»,-ասաց Սուրեն Քրմոյանը:
Նոր փոփոխություններով մտցվում է նաև տեղեկությունների ռեեստրի գաղափարը, դա նշանակում է, որ պետական մարմինն օրենքի ընդունումից հետո պետք է ներկայացնի, թե ինչ տեղեկությունների է տիրապետում:
Ահա օրենքով սահմանված դեպքերում քաղաքացուն տեղեկատվություն չտրամադրելու, այն թաքցնելու համար վարչական պատասխանատվությունը սահմանում է 20-50 հազար դրամ տուգանք: Մեկ տարվա ընթացքում կրկնակի խախտման դեպքում` 100 հազար դրամ: Նույն չափով պատասխանատվություն է սահմանված իր ունեցած տեղեկությունները կայքում չհրապարակելու դեպքում: Օրենքով հստակեցվել է, որ պատասխանատուն տվյալ մարմնի աշխատակազմի ղեկավարն է, եթե այդպիսի հաստիք չունի, ուրեմն տվյալ մարմնի ղեկավարը:
Օրենքով նախատեսված փոփոխություններով հստակեցվել են նաև վճարումների հետ կապված հարցերը:
«Պրակտիկայում որոշ օրենսդրական ակտերում տարբեր կանոններ են կիրառվում, մենք ամրագրում ենք, որ որպես կանոն տեղեկություն ստանալն անվճար է: Մինչև 10 էջ տեղեկություն ստանալը բոլոր դեպքերում անվճար է, 10 էջից ավելի դեպքում կարող է գանձվել այդ տեղեկությունների վերարտադրման ծախսերը: Եթե այլ օրենքներում հակասող դրույթներ կան, ապա պետք է համապատասխանեցվեն այս օրենքներին»,-ասաց նա: Թե որ մարմինն է լիազորվելու հետևել պետական մարմինների աշխատանքին` «Տեղեկատվության ազատության մասին» օրենքով պարտավորություները կատարելու համա ր, դեռ հստակեցված չէ: Առաջիկայում այդ հարցի հետ կապված կլինեն քննարկումներ:
«Տեղակտվության ազատության մասին» ՀՀ օրենքն ընդունվել է 2003 թվականին: Նոր փոփոխությունները ներկայացվել են կառավարությանը, սակայն դեռ դրվելու է հանրային քննարկման:
