Քննիչին մեղադրանք է առաջադրվել պաշտոնեական անփութության համար

ՀՀ հատուկ քննչական ծառայությունում ավարտվել է Ջ. Ամարյանից ստացված հաղորդման հիման վրա վերջինիս պատկանող խոշոր չափերով գույքի հափշտակության փաստով հարուցված քրեական գործի նախաքննությունը: Արդյունքում պարզվել է, որ ՀՀ քննչական կոմիտեի քննիչի` ծառայության նկատմամբ դրսևորած անփույթ և անբարեխիղճ վերաբերմունքի ու պարտականությունները ոչ պատշաճ կատարելու հետևանքով էական վնաս է պատճառվել քաղաքացու օրինական շահերին, հեղինակազրկվել է իրավապահ համակարգը և տեղի ունեցել Ջ. Ամարյանին պատկանող խոշոր չափերով գույքի հափշտակություն: Այս մասին «Արմենպրես»-ին տեղեկացրին ՀՔԾ լրատվական ծառայությունից:
Մասնավորապես, նախաքննությամբ պարզվել է, որ 01.04.2016թ.-ին ՀՀ ՔԿ Երևան քաղաքի քննչական վարչության Արաբկիր վարչական շրջանի քննչական բաժնի ավագ քննիչ Նարեկ Հովհաննիսյանը, իր ղեկավարած քննչական խմբին հանձնարարված քրեական գործի հետ միասին ստացել է նաև դրան կցված` գործով կասկածյալի` Ջ.Ամարյանի խուզարկությամբ հայտնաբերված անձնական իրերի մեկ փաթեթ, որի մեջ եղել է երեք բջջային հեռախոս, ժամացույց և 1.500 ԱՄՆ դոլար արժողությամբ ոսկյա մատանի:
Հիշյալ քրեական գործով նախաքննության ընթացքում ձերբակալված կասկածյալը, ենթադրելով, որ իր տան բանալին ևս գտնվում է վերը նշված փաթեթում, քննիչ Ն. Հովհաննիսյանին խնդրել է բացել այն: Քննիչն էլ, խախտելով ՀՀ օրենսդրության պահանջները, առանց համապատասխան արձանագրություն կազմելու, բացել է կնիքված փաթեթը և բանալին չգտնելով` դրանում առկա իրերը փաթեթավորել երկու առանձին ծրարների մեջ: Ընդ որում, քննիչը չի կատարել նաև օրենքով սահմանված` քրեական գործով վարույթում գտնվող առարկաների պահպանության ապահովման իր պարտականությունը` մատանու և ժամացույցի փաթեթավորումն իրականացրել է այնպիսի եղանակով, որը հետագայում չէր կարող բացառել մատանու կորուստը: Այնուհետև, երբ նախաքննությունը շարունակելու համար քրեական գործն ուղարկվել է մեկ այլ քննչական մարմին, գործն իր վարույթ ընդունած քննիչը, կասկածյալի անձնական իրերը վերջինիս հետ վերադարձնելիս պարզել է, որ փաթեթներում մատանին առկա չէ:
Այսպիսով, պաշտոնեական անփութություն դրսևորելու համար քննիչ Նարեկ Հովհաննիսյանին մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 315-րդ հոդվածի 1-ին մասով: Քրեական գործի նախաքննությունն ավարտվել է: Գործը մեղադրական եզրակացությամբ հանձնվելու է դատավարական հսկողություն իրականացնող դատախազին՝ այն հաստատելու և դատարան ուղարկելու համար:
Ծանուցում. ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
