Արման Թաթոյանը ներկայացրեց հուլիսյան իրադարձությունների հետ կապված ՍԴ-ի որոշումը

ՀՀ մարդու իրավունքների պաշտպան Արման Թաթոյանը հրապարակեց հուլիսյան իրադարձությունների հետ կապված իրենց դիմումի քննությամբ Սահմանադրական դատարանի կայացրած որոշումը: Ապրիլի 21-ին հրավիրված ասուլիսում նա հիշեցրեց, որ ՄԻՊ-ի կողմի Սահմանադրական դատարան ներկայացված դիմումով վիճարկվում էր բոլոր այն օրենսդրական կարգավորումների ու պրակտիկայի սահմանադրականությունը, որոնց հետևանքով 2016 թվականին հուլիսյան իրադարձությունների ժամանակ տեղի էին ունենում իրավունքների խախտումները:
«Խոսքը վերաբերում է անձին ազատությունից զրկելու հիմքերը չներկայացնելու, վերջինիս իրավունքներն ու պարտականությունները չպարզաբանելու, այդ թվում` այլ անձին իր գտնվելու վայրի մասին տեղեկացնելու, փաստաբանի և բժշկի մուտքը ոստիկանության բաժին չթույլատրելու, վարչական ձերբակալման ժամկետը սխալ հաշվելու հետ կապված հարցերին և այլն»,- «Արմենպրես»-ի հաղորդմամբ` ասաց Թաթոյանը:
Ըստ նրա` այս դիմումի հիման վրա 2017 թվականի հունվարի 24-ի սահմանադրական դատարանի որոշմամբ արձանագրվեց, որ «անձի ազատության իրավունքի ապահովման բնագավառում ձևավորվել է ոչ իրավաչափ իրավակիրառ պրակտիկա՝ հնարավոր դարձնելով անգամ Սահմանադրական դատարանի կողմից Սահմանադրությանը հակասող և անվավեր ճանաչված իրավադրույթի՝ ոստիկանության կողմից շարունակական կիրառումը, ինչն իր հերթին երկրում սահմանադրական օրինականությանն ուղղված լուրջ սպառնալիք է»:
«Ավելին, Սահմանադրական դատարանը նույն որոշմամբ արձանագրեց, որ վարչական իրավախախտումների վերաբերյալ ՀՀ նոր օրենսգրքի ընդունման հետաձգումը և, ըստ այդմ, շարունակվող պրակտիկան Հայաստանի Հանրապետության իրավական համակարգի անվտանգության սպառնալիք են»,- ասաց Թաթոյանը:
