Սահմանադրական դատարանը սկսել է քննել ընտրությունների արդյունքներն անվավեր ճանաչելու Կոնգրես-ՀԺԿ դաշինքի դիմումը

Սահմանադրական դատարանը սկսել է քննել ապրիլի 2-ին Հայաստանում կայացած խորհրդարանական ընտրությունների արդյունքները վիճարկելու` Կոնգրես-ՀԺԿ դաշինքի դիմումը: Սահմանադրական դատարանի անդամ Արևիկ Պետրոսյանը նախ տեղեկացրեց, որ 2017թ. ապրիլի 14-ին Սահմանադրական դատարան է մուտքագրվել «Կոնգրես-ՀԺԿ» կուսակցությունների դաշինքի դիմումը` ապրիլի 2-ին կայացած ընտրությունների արդյունքներ ի վերաբերյալ: «Հիշյալ դիմումով բարձրացվել են նաև Ազգային ժողովի ընտրությունների օրը նշանակելու և դրան առնչվող իրավական ակտերի սահմանադրականության հարցերը: Այսպես, ըստ Սահմանադրական դատարանի աշխատակարգային որոշման, Կոնգրես-ՀԺԿ կուսակցությունների դաշինքի դիմումն ընդունվել է քննության այն մասով, որով համապատասխանում է 2005 թ. փոփոխություններով Սահմանադրության գործող պահանջներին, որոնց համաձայն Սահմանադրական դատարանում վեճի առարկա կարող են դառնալ ոչ թե ընտրությունների արդյունքներն ընդհանրապես, այլ ընտրությունների արդյունքներով ընդունված որոշումը և դրա շրջանակում` դիմողին, որպես ընտրական գործընթացին մասնակցած իրավասուբյեկտի, առնչվող հարցերը»,- «Արմենպրես»-ի հաղորդմամբ` նշեց Պետրոսյանը:

Նա մանրամասնեց, որ, դրանից ելնելով, Սահմանադրական դատարանը վեճի առարկա է համարում ՀՀ կենտրոնական ընտրական հանձնաժողովի 2017 թվականի ապրիլի 9-ի` «Հայաստանի Հանրապետության Ազգային ժողովի 2017 թվականի ապրիլի 2-ի ընտրությունների արդյունքներն ամփոփելու մասին» թիվ 163-Ա որոշումը, որով ՀՀ ընտրական օրենսգրքի 95-րդ հոդվածի 1-ին մասի 1-ին կետի հիմքով որոշում է կայացվել Ազգային ժողով ընտրվելու և մանդատների բաշխման մասին:

ՀՀ սահմանադրական դատարանի նախագահ Գագիկ Հարությունյանն առաջարկեց նախ լսել դիմող կողմի բացատրությունները, այնուհետև անցնել ներկայացված նյութերի քննությանը: ՀՀ ՍԴ նախագահն ամբիոնի մոտ հրավիրեց «Քաղաքացի դիտորդ» նախաձեռնության ներկայացուցիչ, իրավաբան Տիգրան Եգորյանին` ներկայացնելու բացատրություններ` կապված դիմումի հետ: Տիգրան Եգորյանն ընդգծեց, որ ընդհանուր իրավիճակին ու խնդիրներին անդրադարձ կկատարի Հայ ազգային կոնգրես կուսակցության փոխնախագահ Լևոն Զուրաբյանը, որից հետո կխոսի նաև փաստաբան Վահե Գրիգորյանը:

ՀԱԿ փոխնախագահ Լևոն Զուրաբյանը նշեց, որ տեղի է ունեցել կազմակերպված զանգվածային կեղծարարություն, ազատ կամքի մերժում, քվեարկության գաղտնիության խախտում: Նա հիշեցրեց, որ  որոշ տեղամասերում  քվեարկության թափանցիկության գլխավոր երաշխավոր տեսախցիկները  մի քանի ժամ չեն աշխատել: Զուրաբյանն անդրադարձավ նաև  մանկապարտեզների, դպրոցների տնօրենների ձայնագրություններին, «ՍԱՍ գրուպ» ընկերության ժողովի ընթացքում արված հայտնի ձայնագրության մասին: Այս ամենը համադրելով` Լևոն Զուրաբյանն արձանագրեց, որ Հայաստանոմ ժողովրդավարական ընտրություններ չեն անցկացվել:

Զուրաբյանն անդրադարձավ նաև ընտրողների թվաքանակին` ընդգծելով, որ արժանահավատ չէ ընտրողների այն թիվը, որը հրապարակել էր ՀՀ ոստիկանության անձնագրային և վիզաների վարչությունը: Նա նշեց, որ վերջին պաշտոնական մարդահամարի տվյալներով Հայաստանի բնակչության թիվը նվազել է, ուստի արժանահավատ չէ, որ 2017թ. ապրիլի 2-ին կայացած Ազգային ժողովի ընտրություններին մասնակցելու իրավունք ունեին 2 միլիոն 588 հազար քաղաքացի:
