Դանիել Իոաննիսյանի ընտանեկան գաղտնիք համարվող տեղեկությունները հրապարակելու դեպքի առթիվ հարուցվել է քրգործ

ՀՀ քննչական կոմիտեի հատկապես կարևոր գործերով քննության գլխավոր վարչությունում հարուցվել է քրեական գործ՝ Դանիել Իոաննիսյանի անձնական և ընտանեկան գաղտնիք համարվող տեղեկությունները ապօրինի հավաքելու և լրատվության միջոցով տարածելու դեպքի առթիվ: Այս մասին «Արմենպրես»-ին տե ղեկացրին ՀՀ քննչական կոմիտեի դեպարտամենտի տեղեկատվության և հասարակայնության հետ կապերի բաժնից:
ՀՀ քննչական կոմիտեի ՀԿԳ քննության գլխավոր վարչության վարույթում ուսումնասիրվել է 2017թ. մարտին մամուլում հրապարակված «Քաղաքացիական ակտիվիստ Դանիել Իոաննիսյանի կենսագրության ուշագրավ դրվագները» խորագրով հոդվածը, որում առկա են Դանիել Իոաննիսյանի ընտանեկան կյանքին վերաբերող տեղեկություններ:
ՀՀ Սահմանադրության 31-րդ հոդվածն ամրագրում է մասնավոր և ընտանեկան կյանքի, պատվի ու բարի համբավի անձեռնմխելիությունը, ըստ որի՝ յուրաքանչյուր ոք ունի իր մասնավոր և ընտանեկան կյանքի, պատվի ու բարի համբավի անձեռնմխելիության իրավունք:
Իսկ ՀՀ Սահմանադրության 34-րդ հոդվածը երաշխավորում է անձնական տվյալների պաշտպանությունը՝ արձանագրելով, որ յուրաքանչյուր ոք ունի իրեն վերաբերող տվյալների պաշտպանության իրավունք, իսկ անձնական տվյալների մշակումը պետք է կատարվի բարեխղճորեն, օրենքով սահմանված նպատակով, անձի համաձայնությամբ կամ առանց այդ համաձայնության` օրենքով սահմանված այլ իրավաչափ հիմքի առկայությամբ:
Նկատի ունենալով, որ ՀՀ քրեական օրենսգիրքը քրեական պատասխանատվություն է նախատեսում մարդու անձնական կամ ընտանեկան կյանքի մասին տեղեկություններն առանց նրա համաձայնության օգտագործելու, հավաքելու, նաև ԶԼՄ-ներով տարածելու համար, իսկ վերոնշյալ հոդվածում առերևույթ հրապարակվել են քաղաքացիական ակտիվիստի ընտանեկան կյանքին վերաբերող տեղեկություններն առանց նրա համաձայնության՝ ՀՀ ՔԿ ՀԿԳ քննության գլխավոր վարչությունում հարուցվել է քրեական գործ՝ ՀՀ քրեական օրենսգրքի 144-րդ հոդվածով։
Ձեռնարկվում են ակտիվ քննչական գործողություններ՝ դեպքի բոլոր հանգամանքների բազմակողմանի, օբյեկտիվ և լրիվ հետազոտումն ապահովելու ուղղությամբ։
Ծանուցում. Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
