Միջադեպ. «Քո ի՞նչ գործն է». դատավորը շրխկացրել է դուռն ու հեռացել. «Հրապարակ»

«Հրապարակ» թերթը գրում է. «Ավելի քան երեք տասնյակ փաստաբաններ 2016 թվականի դեկտեմբերին դիմել էին դատավորների ընդհանուր ժողովի էթիկայի եւ կարգապահական հարցերի հանձնաժողովին՝ ՀՀ վճռաբեկ դատարանի նախագահ Արման Մկրտումյանի նկատմամբ կարգապահական վարույթ հարուցելու հարցով։
Փաստաբանների համար նման հիմք էր հանդիսացել 2016 թվականի հոկտեմբերի 27-ին ՄԻԵԴ հայտնի վճիռն ընդդեմ Հայաստանի ՝ Բուզանդի փողոցի բնակիչների՝ «Վարդանյանն ու Նանուշյանն ընդդեմ Հայաստանի» գործով, որտեղ գնահատականներ են տրված վճռաբեկ դատարանի նախագահ Ա. Մկրտումյանի գործողություններին։
Հանձնաժողովը, սակայն, վարույթ չէր հարուցել՝ պատճառաբանելով, որ Մկրտումյանն այդ գործողությունները կատարելիս հանդես չի եկել իբրեւ վճռաբեկ դատարան, իսկ վարույթ կարող է հարուցվել դատարանի գործողությունների նկատմամբ, ոչ թե դատարանի կազմի դատավորներից մեկի գործողությունների։
Նիստի ժամանակ միջադեպ էր եղել, մեր տեղեկություններով, հանձնաժողովի անդամներից մեկը՝ վերաքննիչ քրեական դատարանի դատավոր Մխիթար Պապոյանը հայտարարել էր, որ իսկապես, պետք է վարույթ հարուցել, բոլոր հիմքերը կան։ Այդտեղ միջամտել էր Արդարադատության խորհրդի մի աշխատակից, դատավորը սաստել էր վերջինիս, թե «քո ի՞նչ գործն է, ինչո՞ւ ես միջամտում»։ Ապա դիմել էր նիստը նախագահող Մնացական Մարտիրոսյանին՝ պահանջելով կարգի հրավիրել ԱԽ աշխատակցին։ Սակայն վերջինս որեւէ քայլ չէր ձեռնարկել, Պապոյանը բարկացել էր, դուռը շրխկացրել եւ դուրս եկել։
Այդ պատճառով էլ վարույթ չհարուցելու որոշման տակ բացակայում է 7-րդ անդամի՝ Մխիթար Պապոյանի ստորագրությունը»:
