ԴԱՀԿ պաշտոնյան չարաշահել է պաշտոնեական դիրքը. հափշտակվել է խոշոր չափերի գումար

ՀՀ հատուկ քննչական ծառայությունում ավարտվել է պաշտոնատար անձի կողմից յուրացնելու եղանակով խոշոր չափերով գումար հափշտակելու դեպքի վերաբերյալ քննված քրեական գործի նախաքննությունը: Արդյունքում պարզվել է, որ ՀՀ ԱՆ ԴԱՀԿ ծառայության պաշտոնյան իր կողմից հարուցված կատարողական վարույթներով  պարտապան Արմեն Քոչարյանից ստացել է բռնագանձման ենթակա խոշոր չափերի գումար, որոնք, պաշտոնեական դիրքն օգտագործելով, յուրացրել և ծախսել է անձն ական կարիքների համար: Այս մասին «Արմենպրես»-ին տեղեկացրին ՀՔԾ լրատվական ծառայությունից:

Մասնավորապես,  ԴԱՀԿ ծառայության հարկադիր կատարող Գրիգոր Սարգսյանն իր կողմից հարուցված կատարողական վարույթի շրջանակներում պարտապան` Երևանի բնակիչ Արմեն Քոչարյանից  2012-2013 թթ.-ի ընթացքում մաս-մաս ստացել է արգելադրման ենթակա 7000 դոլարից 3500 ԱՄՆ դոլար, ինչպես նաև պետական տուրքի և կատարողական գործողությունների կատարման ծախսի համար նախատեսված 150 ԱՄՆ դոլար: Հարկադիր կատարողը պարտավոր է եղել հիշյալ գումարներն օրենսդրությամբ սահմանված կարգով ոչ ուշ, քան դրանք առգրավելու հաջորդ օրը հանձնել  ԴԱՀԿ ծառայության դեպոզիտ հաշվին, ինչը չի կատրել: Դրա փոխարեն Գրիգոր Սարգսյանը, օգտագործելով իր պաշտոնեական դիրքը, իրեն ի պաշտոնե վստահված 3650 ԱՄՆ դոլար գումարը յուրացրել է` այն օգտագործելով անձնական կարիքների համար:

Այսպիսով, յուրացնելու եղանակով խոշոր չափերով գումար հափշտակելու համար ԴԱՀԿ ծառայության հարկադիր կատարող Գրիգոր Սարգսյանին մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 179-րդ հոդվածի 2-րդ մասի 1-ին և 3-րդ կետերով: Քրեական գործի նախաքննությունն ավարտվել է: Գործը մեղադրական եզրակացությամբ հանձնվել է դատավարական հսկողություն իրականացնող դատախազին` այն հաստատելու և դատարան ուղարկելու համար:

Ծանուցում. ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
