Հայաստանի Հանրապետության աշխատանքային օրենսգրքում սպասվում են փոփոխություններ, որոնք փոքր բիզնեսը կազատեն որոշ գործառույթներից: «Արմենպրես»-ի մամուլի սրահում հրավիրված ասուլիսում ՀՀ աշխատանքի և սոցիալական հարցերի նախարարի աշխատանքի և զբաղվածության հարցերով գլխավոր խորհրդական Թադևոս Ավետիսյանը նշեց, որ նախատեսվում են ի շարք քայլեր, որոնց արդյունքում փոքր բիզնեսը «շունչ կքաշի»:
«Օրինակ՝ բազմաթիվ դիմումներ կային փոքր ձեռնարկություններից, որոնք բարձրաձայնում էին, որ իրենց համար բավական բարդ է Աշխատանքային օրենսգրքով նախատեսված դրույթների ամբողջական կիրառումը: Ավելին, շատ դեպքերում, այդ կարգավորումներն իրենց համար ավելորդ են: Ասենք, մեկ կամ երկու աշխատող ունեցող մի ընկերություն պարտավոր է ունենալ ներքին կարգապահական կանոններ, ընդունի ներքին իրավական ակտեր: Եվ որպեսզի այդ ամենը, փաստաթղթային մասը, վարչարարությունը կարողանան ապահովել, ստիպված են լինում վարձել հաշվապահներ, իրավաբաններ: Այս պարագայ ում իրենք լրացուցիչ ծախսեր են անում իրենց առավել սուղ միջոցներից»,-ասաց Թադևոս Ավետիսյանը:
Նրա խոսքով՝ միջազգային փորձը ցույց է տալիս, որ առանձին երկրներում փոքր ձեռնարկությունների համար Աշխատանքային օրենսգրքում ճկուն մոտեցումներ են սահմանված:
Մյուս կարևոր հարցը վերաբերում է հավելումներին, հավելավճարներին, որոնք նախատեսված են գիշերային, արտաժամյա, տոնական օրերի աշխատանքի համար:
«Օրենքով սահմանված է արտաժամյա աշխատանքի համար 50 տոկոս հավելում, տոնական օրերին աշխատելու դեպքում աշխատողը կրկնակի պետք է վարձատրվի: Այսպիսի սահմանափակումները շատ հաճախ գերփոքր ընկերությունների համար խոչընդոտ են հանդիսանում, որովհետև այդ ընկերությունները շատ ավելի մեծ ռիսկի և մրցակցության պայմաններում են աշխատում: Այդպիսի ընկերություններն առնվազն 5-6 անգամ ավելի արագ փակվում ու նորերն են ստեղծվում: 2-3 հոգով աշխատող փոքր ձեռնարկությունը փորձում է «արևի տակ իր տեղն ունենալ», ինչ-որ ձևով զարգանալ, այս դեպքում օրենքով կոշ տ կարգավորում սահմանելը, որ արտաժամյա աշխատանքի համար 50 տոկոս վճարի, դժվարություններ է առաջացնում»,- ասաց Թադևոս Ավետիսյանը: Հետևաբար` ձեռնարկությունը նման դեպքում կամ լրացուցիչ ծախսեր է անում` վարձելով իրավաբանի, հաշվապահի, կամ դիմում է ստվերի` այդ ամենը փաստաթղթավորում է, բայց իրականում անում է այն, ինչպես աշխատողի հետ պայմանավորվում է: Հետևաբար` նախատեսվում է այդ վճարումները թողնել գործատուի և աշխատողի պայմանավորվածությանը:
Արդյոք ռիսկեր չի՞ պարունակում այդ վճարումները գործատուի և աշխատողի պայմանավորվածությանը թողնելը: Չէ՞ որ կարող է այնպիսի իրավիճակ լինել, որ գործատուն ընդհանրապես չվճարի: Այդ հարցերին ի պատասխան՝ Թադևոս Ավետիսյանը նշեց, որ ամբողջ աշխարհում այնպես է, որ գործատուն և աշխատողն են պայմանավորվում ինչ աշխատանք արվի, որքան վճարվի:
Մեկ սպասվող փոփոխության մասին ևս: Նախատեսվում է փոքր ձեռնարկությունների համար սահմանել աշխատանքային պայմանագրի օրինակելի ձև, որը կներառի նվազագույն պահանջները: Դա գործատուի համար օգտակար կլինի, արդեն պատրաստի պայմանագիր է լրացվելու, պետք չի լինի լրացուցիչ մասնագետներ վարձել, վճարումներ կատարել պայմանագրեր կազմելու համար:
