Աշխատավարձերի ուշացում, թաքնված զբաղվածություն. պաշտոնյան ներկայացնում է աշխատաշուկայում տարածված խախտումները

Աշխատավարձերի ուշացում, աշխատավարձի ոչ ամբողջական վճարում, հանգստի իրավունքի խախտում, թաքնված զբաղվածություն։ Սրանք աշխատաշուկայում առավել տարածված խախտումներն են: «Արմենպրես»-ի մամուլի սրահում հրավիրված ասուլիսում ՀՀ աշխատանքի և սոցիալական հարցերի նախարարի աշխատանքի և զբաղվածության հարցերով գլխավոր խորհրդական Թադևոս Ավետիսյանը նշեց, որ աշխատակցի չգրանված լինելն իր հերթին խնդիրների է բերում:
«Եթե աշխատողը գրանցված չէ, ապա դա նշանակում է, որ տվյալ անձը պաշտպանված չէ: Այսինքն` աշխատողի իրավունքը խախտվելու դեպքում չկա հիմք, որով նա կարող է իր իրավունքները պաշտպանել»,-ասաց Թադևոս Ավետիսյանը: Նրա խոսքով՝ պակաս կարևոր չեն աշխատանքից անօրինական ազատումները:
Աշխատողի իրավունքի պաշտպանության իրավակարգավորումները տալիս են հետևյալ հնարավորությունները՝ աշխատողի իրավունքի խախտման դեպքում առաջին օղակը նրա և գործատուի բանակցություններն են, երկրորդ օղակը` արհմիություններն են, հաջորդը՝ դատական կարգով աշխատողների իրավունքների պաշտպանության հնարավորությունն է: Աշխատողը կարող է նաև դիմել համապատասխան պետական մարմիններին:
Թադևոս Ավետիսյանը նշեց, որ Հայաստանում աշխատողների իրավունքների պաշտպանությունը՝ ոչ պետական պաշտպանության միջոցներով, այսինքն՝ արհմիություններով իրականացնելը հեռու է լիարժեք լինելուց:
«Այստեղ շատ անելիքները կան, և պետության խնդիրն է բարձրացնել արհմիությունների դերը, որպեսզի աշխատողներն իրենց իրավունքները դատական կարգով պաշտպանելուց բացի, աշխատանքային հարաբերությունները կարգավորեն նաև արհմիությունների միջոցով»,- ասաց նա:
