Քրեակատարողական հիմնարկներում փաստաբանների խուզարկությունը արգելված է օրենքով: «Արմենպրես»-ի հետ զրուցում նշեց ՀՀ արդարադատության նախարարի տեղակալ Արթուր Հովհաննիսյանը: Նրա խոսքով` թեև կալանավորվածներին պահելու վայրերի և ուղղիչ հիմնարկների ներքին կանոնագրքով նշված է, որ ցանկացած անձ քրեակատարողական հիմնարկ մուտք ու ելքի ժամանակ կարող է քրեակատարողական հիմնարկի աշխատակցի կողմից խուզարկության ենթարկվել մինչև կալանավորին կամ դատապարտյալին հասնելը, սակայն մյուս կողմից համաձայն «Փաստաբանության մասին» ՀՀ օրենքի` քրեակատարողական հիմնարկներում արգելվում է փաստաբաններին խուզարկելը:
«Այստեղ մենք ունեցանք երկու իրավական ակտերի կոլիզիա (հակադիր շահերի, ձգտումների, հայացքների բախում-հեղ.), ուստի արդարադատության նախարարությունը քրեակատարողական վարչության պետի և Փաստաբանների պալատի նախագահի հետ համատեղ կազմակերպեց քննարկում, որտեղ հստակ որոշվեց, որ այս դեպքում աշխատում է «Փաստաբանության մասին» ՀՀ օրենքը»,- ընդգծեց Հովհաննիսյանը:
Արդարադատության նախարարի տեղակալը նշեց, որ քրեակատարողական հիմնարկի աշխատակիցները փաստաբաններին միայն կարող են համապատասխան սարքերով զննել:
