ՀՀ քննչական կոմիտեում մեկ տարում քրեական գործերով որպես մեղադրյալ է ներգրավվել 136 անչափահաս

Անչափահասների մասնակցությամբ կատարված հանցագործությունները քննչական կոմիտեի հատուկ ուշադրության կենտրոնում են: «Արմենպրես»-ի հաղորդմամբ` մայիսի 6-ին անչափահասների մասնակցությամբ և նկատմամբ կատարվող հանցագործությունների վերաբերյալ Քննչական կոմիտեում կազմակերպված քննարկման ժամանակ ասաց ՀՀ քննչական կոմիտեի նախագահ Աղվան Հովսեփյանը:

Նրա խոսքով` վիճակագրությունը փաստում է, որ երեխաների նկատմամբ, ինչպես նաև անչափահասների կողմից կատարված հանցագործությունները զգալի թիվ են կազմում: «Շատ էական նշանակություն ունի անչափահասների քրեաիրավական պաշտպանության հարցը և քննչական կոմիտեի աշխատանքը այս հարցում: Վիճակագրությունը նույնպես մեզ պարտադրում է ամենայն լրջությամբ այդ հարցին հատուկ ուշադրություն դարձնել»,-ասաց Հովսեփյանը:

Նա նշեց, որ 2016 թվականի ընթացքում ՀՀ քննչական կոմիտեի վարույթում անչափահասների մասնակցությամբ քննված 107 քրեական գործերով նախաքննությունն ավարտվել է և մեղադրական եզրակացություններով ուղարկվել դատարան: «Այդ գործերով, որպես մեղադրյալ ներգրավված 167 անձանցից 136-ը եղել են անչափահասներ»,- նշեց Հովսեփյանը: Ըստ նրա` քրեական գործերի մեծ մասը` 52-ը հարուցվել է գողության հատկանիշներով, մնացած քրեական գործերից 9-ը դիտավորությամբ առողջությանը ծանր վնաս հասցնելն է, 4-ը` սպանության և այլն:

«Սակայն քննչական մարմինները ոչ բոլոր դեպքերում են երեխաների մասնակցությամբ կատարված հանցագործությունները ուղարկվել դատարան: Մենք փորձել ենք նրանց նկատմամբ կիրառել օրենքով նախատեսված հումանիստական ինստիտուտները. նման հիմքով կարճվել է 46 քրեական գործ»,- ասաց Հովսեփյանը:

Նա նշեց, որ 2016 թվականին քննչական կոմիտեի  քրեական վարույթում է գտնվել անչափահասների նկատմամբ կատարված հանցագործությունների  վերաբերյալ 200 քրեական գործ:

«Այդ հանցագործությունները նույնպես տարաբնույթ և տարատեսակ են: 6 դեպքում անչափահասներին ինքնասպանության հասցնելուն է վերաբերվում: Այս վիճակագրական տվյալները ցույց են տալիս, որ պետք է ուշադրություն դարձվեն անչափահասների կողմից և նկատմամբ կատարվող հանցագործությունների  ավելի մասնագիտական քննության ապահովմանը»,- ընդգծեց Հովսեփյանը:

ՀՀ քննչական կոմիտեի տարբեր մարմինների և ստորաբաժանումների թվով 21 քննիչներ մարտի 17-ից մայիսի 5-ը անցել են անչափահասների մասնակցությամբ  հանցագործություններին վերաբերվող հատուկ դասընթացներ: Դասընթացների ընթացքում քննիչներին ներկայացվել է օրենքի հետ առնչություն ունեցող և դատավարական տարբեր կարգավիճակ ունեցող անչափահասների հետ վարվեցողության կանոնները, դրանց առանձնահատկությունները: Դասընթացներ անցած բոլոր մասնակիցները հաջողությամբ հանձնել են թեստերը, ինչի առթիվ ՀՀ քննչական կոմիտեում անցկացվեց հավաստագրերի հանձման արարողութ յունը:  

Դասընթացները կազմակերպվել են «Փրոջեքթ Հարմոնի» կազմակերպության հայկական մասնաճյուղի հետ համատեղ` ԱՄՆ պետքարտուղարության ֆինանսավորմամբ:
