ՄԻՊ-ը ներկայացրել է ազատությունից զրկված անձանց վիճակը բարելավող օրենսդրական նախագծեր

ՀՀ արդարադատության նախարարության քրեակատարողական հիմնարկներում կատարված ուսումնասիրությունների և ստացված բողոքների քննարկման արդյունքների հիման վրա ՀՀ մարդու իրավունքների պաշտպանի աշխատակազմում մշակվել են ՀՀ քրեակատարողական օրենսգրքում,«Ձերբակալված և կալանավորված անձանց պահելու մասին», ինչպես նաև «Նույնականացման քարտի մասին» ՀՀ օրենքներում փոփոխություններ և լրացումներ նախատեսող օրենքների նախագծեր՝ համապատասխան հիմնավորումներով: Այս մասին տեղեկացրին ՀՀ Մարդու իրավունքների պաշտպանի աշխատակազմից:
Նախագծերն ուղղված են ազատությունից զրկված անձանց կապի ամրապնդմանը մերձավոր ազգականների հետ, քրեակատարողական հիմնարկում նրանց վիճակի բարելավմանը:
Այդ հարցերը տեղ են գտել նաև ՀՀ մարդու իրավունքների պաշտպանի՝ որպես կանխարգելման ազգային մեխանիզմի տարեկան զեկույցում, ինչպես նաև քննարկվել են Պաշտպանին առընթեր Խոշտանգումների կանխարգելման փորձագիտական խորհրդում:
Նախագծերով, մասնավորապես, առաջարկվում է.
- ազատազրկման դատապարտված և կալանավորված անձանց կարճատև և երկարատև տեսակցություններ, ինչպես նաև կարճատև մեկնումներ տրամադրելու հիմքում դնել ոչ թե անձի կատարած հանցագործության ծանրության աստիճանը, այլ հաշվի առնել վերջինիս անհատական վարքագիծը և ռիսկայնությունը,
- կալանավորված անձանց համար նախատեսել երկարատև տեսակցության հնարավորություն,
- մերձավոր ազգականների հետ կապն ապահովելու նպատակով նախատեսել դատապարտյալին քրեակատարողական մեկ հիմնարկից նույն տեսակի մեկ այլ հիմնարկ տեղափոխելու օրենսդրական հիմք,
- առանց խնամքի մնացած երեխա ունեցող դատապարտյալի համար նախատեսել կարճաժամկետ մեկնում տրամադրելու հնարավորություն՝ երեխային մանկատանը կամ ազգականի մոտ տեղավորելու նպատակով,
- ժամանակավոր վկայական ստանալու հնարավորություն նախատեսել ոչ միայն ազատազրկման դատապարտված, այլ նաև կալանավորված անձանց համար,
- քաղաքացիաիրավական գործարքներ կնքելու խնդրանքի հիման վրա վերցված ժամանակավոր վկայականը կամ նույնականացման քարտը տրամադրելու պարտականություն նախատեսել ոչ միայն ազատազրկման դատապարտված, այլ նաև կալանավորված և ձերբակալված անձանց համար:
Վերոնշյալ նախագծերը և դրանց հիմնավորումները ներկայացվել են ՀՀ արդարադատության նախարարություն՝ օրենքով սահմանված կարգով շրջանառության մեջ դնելու համար: ՀՀ մարդու իրավունքների պաշտպանի կողմից նախագծերը կարծիքի կուղարկվեն նաև համապատասխան իրավապաշտպան կազմակերպություններին:
Ստացած կարծիքները կքննարկվեն բոլոր շահագրգիռ մարմինների և իրավապաշտպան կազմակերպությունների հետ՝ ՀՀ Ազգային ժողով ներկայացնելու նպատակով:
