INTERVIEW
«Սարգսյան իրավաբանական խումբ» իրավաբանական միավորման ղեկավար, իրավաբան Տիգրան Սարգսյանը համոզված է, որ սահմանադրական փոփոխություններով պառլամենտական կառավարման կարգի ներդրման իմիտացիա է արվում:
Past.am-ի հետ զրույցում նա մասնավորապես նշեց. «Եթե մենք ցանկանում ենք ունենալ պառլամենտական կառավարման կարգ, նախ՝ պետք է պառլամենտ ունենանք, հակառակ դեպքում՝ սահմանադրական փոփոխությունները կարող են ծանր հետևանքներ ունենալ մեր պետության համար»:
Ըստ իրավաբանի` սահմանադրական նորմերը պետք է դիտարկել իրականության մեջ: Մեր զրուցակցի կարծիքով՝ Ազգային ժողովն իր որակներով շատ հեռու է պետական կառավարում իրականացնելու հնարավորություն ունենալուց:
«Պառլամենտական վերահսկողական սահմանադրական մեխանիզմները չեն կարող կենսագործվել Ազգային ժողովում պատգամավոր չունենալու պատճառով: Եղած պատգամավորները չեն կարող պատգամավոր համարվել: Արդյունքում, մենք կարող ենք ունենալ սուպեր վարչապետական կառավարման կարգ, որն աննախադեպ կլինի աշխարհում իր բացասական հետևանքներով: Յուրաքանչյուրս կարող ենք հետևել պառլամենտի աշխատանքներին: Ընդունված օրինագծերի գրեթե 98 տոկոսը կառավարության հեղինակածն է: Ստացվում է, որ կառավարությունը և՛ օրենսդիր, և՛գործադիր ֆունկցիա է կատարում: Սա հատուկ է ավտորիտար կառավարման համակարգին: Գործող սահմանադրության պայմաններում կառավարությունը գոնե վերահսկելի է նախագահի կողմից: Սահմանադրական փոփոխությունների արդյունքում կառավարությունը փաստացի անվերահսկելի կլինի»,- ընդգծեց Տիգրան Սարգսյանը:
«Սարգսյան իրավաբանական խումբ» իրավաբանական միավորման ղեկավարի պնդմամբ՝ նախագծով էապես բարձրանում է պետական կառավարման կարևորագույն ինստիտուտի՝ խորհրդարանի դերը, բայց ցավալի է, որ դե ֆակտո մենք խորհրդարան չունենք: «Խորհրդարանում միտումնավոր հավաքել են մարդկանց, ովքեր իրենց որակներով չեն կարող իրականացնել իրենց առջև դրված խնդիրները: Դրանով էլ անվերահսկելի կդառնա կառավարությանը: Եթե գնում են սահմանադրական փոփոխությունների նման ճանապարհով, ապա անհրաժեշտ է դադարեցնել գործող Ազգային ժողովի լիազորությունները, նոր ընտրություններով ընտրել նոր որակներով նոր մարդկանց, հետո նոր քվեարկության դնել սահմանադրական փոփոխությունների ներկայացված նախագիծը»,- խոսքը եզրափակեց Տիգրան Սարգսյանը:
