ՄԻՊ-ն արձանագրել է ցմահ ազատազրկման դատապարտված անձի իրավունքների խախտում

ՀՀ մարդու իրավունքների պաշտպանը առաջարկ է ներկայացրել մարդու իրավունքների և ազատությունների խախտումները վերացնելու մասին: Այն վերաբերում է ցմահ ազատազրկման դատապարտված անձի` ընտանիքի անդամների բնակության վայրին հնարավորինս մոտ գտնվող քրեակատարողական հիմնարկ տեղափոխվելու խնդրին: Այս մասին «Արմենպրես»-ին տեղեկացրին Մարդու իրավունքների պաշտպանի աշխատակազմից:
Քրեակատարողական ծառայության կենտրոնական մարմնի տեղաբաշխման հանձնաժողովը մերժել է ցմահ ազատազրկման դատապարտված անձի դիմումը՝ իրեն ընտանիքի անդամի բնակության վայրին մոտ գտնվող քրեակատարողական հիմնարկ տեղափոխելու մասին, թեպետ գործնականում պատժի ամբողջ ժամկետը մեկ ուղղիչ հիմնարկում կրելու ընդհանուր կանոնը միատեսակ կիրառելիություն չունի: Խախտման որոշման մեջ Մարդու իրավունքների պաշտպանը բարձրացրել է ցմահ ազատազրկման դատապարտված անձանց անջատ պահելու վերանայման հարցը՝ վկայակոչելով ցմահ կամ այլ երկարատև ազատազրկման դատապարտված ա նձանց տարանջատման արգելման միջազգայնորեն հռչակված սկզբունքը (non-segregation principle):
Շեշտադրվել է նաև ցմահ ազատազրկման դատապարտված անձանց անջատ պահելու պահանջի վերանայմանն ուղղված օրենսդրական նախագծի մշակման անհրաժեշտությունը:
Պաշտպանի աշխատակազմում մշակվել է օրենսդրական փոփոխությունների փաթեթ, որով առաջարկվում է դատապարտյալին մեկ ուրիշ ուղղիչ հիմնարկ տեղափոխելիս, որպես հիմք, դիտարկել նաև մերձավոր ազգականների հետ կապն ապահովելու նպատակը:
