Ավարտվել է Արարատի և Վայոց ձորի մարզերի դատարանի դատավորի վերաբերյալ քրգործի նախաքննությունը

Դատավորի կողմից կաշառք ստանալու փաստով Հատուկ քննչական ծառայությունում հարուցված քրեական գործի նախաքննության ընթացքում հավաքված բավարար փաստերի համակցության հիման վրա պարզվել է, որ ՀՀ Արարատի և Վայոց ձորի մարզերի ընդհանուր իրավասության առաջին ատյանի դատարանի դատավոր Լևոն Արազյանը ամբաստանյալի օգտին որոշակի գործողություններ կատարելու համար նրանից անձամբ կաշառք է պահանջել և ստացել: Այս մասին տեղեկացրին ՀՔԾ լրատվական ծառայությունից:
Այսպես, նախաքննությամբ հիմնավորվել է, որ դատավոր Լ. Արազյանի կողմից 07.03.2017թ.-ին վարույթ ընդունած քրեական գործով, ինքնիրավչություն կատարելու համար Գրիգոր Շամասուրյանին մեղադրանք է առաջադրված եղել ՀՀ քրեական օրենսգրքի 322-րդ հոդվածի 1-ին մասով, սակայն դրանով նախատեսված սանկցիայի շրջանակներում առավել մեղմ պատժատեսակ` կալանքի փոխարեն 300.000 ՀՀ դրամի չափով տուգանք նշանակելու համար, դատավորն ամբաստանյալից պահանջել է 600 ԱՄՆ դոլարի կաշառք: Լ. Արազյանը Գ. Շամասուրյանի հետ նախապես պայմանավորվածություն է ձեռք բերել, որպեսզի վերջինս պահանջված գում արն իրեն հանձնի դատավճիռը հրապարակելուց հետո` մի քանի օր անց: Պայմանավորվածության համաձայն` դատավոր Լ. Արազյանն իր պահանջած կաշառքն ամբաստանյալից անձամբ ստացել է 11.05.2017թ.-ին` Վեդի քաղաքի իր նստավայրում գտնվող դատարանի շենքում:
Ինչպես արդեն Հատուկ քննչական ծառայությունը տեղեկացրել է, համապատասխան ընթացակարգի ավարտից հետո, դատավորին մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 311-րդ հոդվածի 4-րդ մասի 3-րդ կետով` ամբաստանյալի օգտին որոշակի գործողություններ կատարելու համար նրանից անձամբ կաշառք պահանջելու և ստանալու համար: Լ. Արազյանի նկատմամբ որպես խափանման միջոց է ընտրվել կալանավորումը:
Սույն քրեական գործով կազմվել է մեղադրական եզրակացություն, և գործը հանձնվել է դատավարական հսկողություն իրականացնող դատախազին` մեղադրական եզրակացությունը հաստատելու և դատարան ուղարկելու համար:
Ծանուցում. ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
