«Փաստ» օրաթերթը գրում է.

Նախկին գլխավոր դատախազ Գևորգ Կոստանյանը, ով եղել է կոռուպցիայի դեմ պայքարի խորհրդի անդամ, չի հավատում, որ արդարադատության նախկին նախարար, ԱԺ փոխնախագահ Արփինե Հովհաննիսյանի օրենսդրական նախաձեռնությամբ ստեղծվող կոռուպցիայի կանխարգելման հարցերով նոր մարմինը կիրականացնի կոռուպցիայի դեմ արդյունավետ պայքար: Ըստ Կոստանյանի՝ մենք կարող ենք ստեղծել այդպիսի 10 մարմին, բայց դա չի նշանակում, որ այդ մարմնի ստեղծման հանգամանքը կարող է նպաստել կոռուպցիայի դեմ պայքարի արդյունավետությանը:

Նշենք, որ Արփինե Հովհաննիսյանի օրենսդրական առաջարկով Բարձրաստիճան պաշտոնյաների էթիկայի հանձնաժողովի հիման վրա ստեղծվելու է հակակոռուպցիոն մարմին, որը կարգավորելու է կոռուպցիայի կանխարգելման, շահերի բախման, հայտարարագրման, էթիկայի կանոնների, անհամատեղելիության պահանջների, բարձրաստիճան պաշտոնատար անձի և հանրային ծառայողի նկատմամբ կիրառվող այլ սահմանափակումների, նվերներ ընդունելու արգելքի հարցերը: Ինչպես նաև՝ սույն օրենքի պահանջների խախտման համար պատասխանատվության հետ կապված հարաբերությունները:

«Մենք պետք է տեսնենք, թե արդյոք այդ մարմնի գործունեության սկզբունքները, այդ մարմնի ստեղծման և ձևավորման հանգամանքները տալի՞ս են արդյունավետ գործելու այդ հնարավորությունը: Այո, այստեղ խոսում ենք քաղաքական կամքի մասին: Այս մարմնի ստեղծումն ինքնին նշանակում է, որ երկրում քաղաքական կամքն այնպիսին է, որ առաջ ենք գնում՝ կոռուպցիայի դեմ պայքարի մեխանիզմների ճշտության և հստակության տեսակետից»,– նոր նախաձեռնության առթիվ կասկած հայտնեց նախկին գլխավոր դատախազը:

Որպես նախկին գլխավոր դատախազ, ով եղել է կոռուպցիայի դեմ պայքարի խորհրդում, Գևորգ Կոստանյանը համոզված է, որ խորհրդատվական մարմինները չեն կարող արդյունավետ լինել կոռուպցիայի դեմ պայքարի գործում, անգամ եթե դրանում ընդդիմադիրներ ներգրավված լինեն:

«Մենք քաղաքական տեսակետից կարող ենք ունենալ ընդդիմության ներկայացուցիչներ այդ մարմնում, բայց այդ մարմինը չգործի արդյունավետ: Պետք է լինի այնպիսի մարմին, որ բոլոր անդամներն այն չափանիշներին համապատասխանեն, այն ձևով ընտրվեն, որպեսզի այդ մարմնի գործունեությունն արդյունավետ լինի: Մեխանիկորեն այդ անդամներից 5–ից 4–ն էլ ընդդիմության ներկայացուցիչ լինեն՝ դա դեռևս չի երաշխավորում այդ մարմնի և՛ անկախությունը, և՛ աշխատանքի արդյունավետությունը: Այսինքն՝ ինքնանպատակ չէ, որ ընդդիմության ներկայացուցիչ լինի»,– պարզաբանեց Կոստանյանը:

Մինչդեռ, ըստ Արփինե Հովհաննիսյանի, օրենքի նպատակն է հակակոռուպցիոն ինստիտուցիոնալ կանխարգելիչ համակարգի սահմանումը, հանրային ծառայողների կարգապահության և բարեվարքության ամրապնդումը, հայտարարագրման համակարգի գործուն կառուցակարգերի ամրագրումը, բարձրաստիճան պաշտոնատար անձի և հանրային ծառայողի անհամատեղելիության պահանջների և վերջիններիս նկատմամբ կիրառվող այլ սահմանափակումների սահմանումը:

Նկատենք, որ բարձրաստիճան պաշտոնյաների էթիկայի հանձնաժողովը ևս՝ որպես անկախ մարմին, ի վերջո չկարողացավ իր դերակատարությունն իրականացնել և նոր փաթեթավորմամբ ընդամենը փորձ է արվում կոռուպցիայի դեմ պայքարի նոր իմիտացիա ստեղծել:
