Արցախի դիրքերից մեկում, նախնական տվյալներով, ծառայակցի կողմից սպանված 19-ամյա ժամկետային զինծառայող Հովհաննես Հարությունյանի գործով դատական նիստին ցուցմունք են տվել զորամասի վաշտի եւ գումարտակի հրամանատարները: NEWS.am-ի հետ զրույցում  Հովհաննեսի մայրը՝ տիկին Լյուդան, նշեց, որ երկու հրամանատարն էլ նշել են, որ Հովհաննեսը եղել է դրական եւ օրինակելի զինծառայող:

«Հովոյիս մասին շատ դրական արտահայտվեցին, ասացին, որ դեպքի հաջորդ օրը տուն պետք է գար, արձակուրդ էին տվել լավ ծառայության համար, Հովոս պետք է գար տուն՝ չհասցրեց»,-ասաց նա:

Ի տարբերություն Հովհաննես Հարությունյանի, գործով ամբաստանյալ Միքայել Զաքարյանի մասին խոսելիս, ըստ տիկին Լյուդայի,  հրամանտարները նշել են, որ նա աչքի է ընկել իր վատ վարքով. «Մի քանի անգամ առանց զգուշացնելու զորմասը լքել է, պատժել են, անընդհատ նեղել է ծառայակիցներին: Վատ բաներ ասեցին նրա մասին»,-ասաց նա:

Հրամանատարները նաեւ իրենց ցուցմունքում նշել են, որ դեպքից անմիջապես հետո, երբ դիրքեր են գնացել, Միքայել Զաքարյանը ցույց տալով արդեն մահացած Հովհաննեսին, ասել է՝ «Ինքն իրեն խփել է», սակայն, փորձաքննությամբ հաստատվել է, որ Հովհաննես Հարությունյանին կրակել են 1-2 մ տարածությունից:

Ըստ մեղադրական եզրակացության` Միքայել Զաքարյանը վիճաբանության մեջ է մտել համածառայակից Հովհաննես Հարությունյանի հետ եւ ինքնաձիգով հանկարծակի դիտավորությամբ մեկ անգամ կրակել վերջինի վրա եւ սպանել: Բացի դրանից, վիճաբանության մեջ է մտել շարքային Սամվել Զեյնալյանի հետ, եւ բռունցքով մեկ անգամ հարվածել նրան: Սամվել Զեյնալյանը նույնպես բռնություն է գործադրել նրա նկատմամբ:

Միքայել Զաքարյանին մեղադրանք է առաջադրվել Քրեական օրենսգրքի 104-րդ հոդվածի 2-րդ մասի 10-րդ կետով եւ 359-րդ հոդվածի 1-ին մասով, իսկ Սամվել Զեյնալյանին` 359-րդ հոդվածի 1-ին մասով: Միքայելը կալանավորված է, իսկ Սամվելի նկատմամբ խափանման միջոց է ընտրվել ստորագրություն չհեռանալու մասին:

Նշենք, որ Հովհաննես Հարությունյանի իրավահաջորդի շահերի պաշտպան Անի Չատինյանը ավելի վաղ մեզ հետ զրույցում հայտնել էր, որ փորձաքննության արդյունքներով ապացուցվում է, որ 19-ամյա զինծառայողին սպանելու մեջ մեղադրվող նրա ծառայակից 19-ամյա Միքայել Զաքարյանը մեղավոր է: Բացի այդ, փաստաբանի խոսքով, համալիր դատահոգեբանական, դատաբժշկական փորձաքննությունների համաձայն Միքայել Զաքարյանը մեղսունակ է ճանաչվել:

Միքայել Զաքարյանն իրեն առաջադրված մեղադրանքում մեղավոր չի ճանաչում: Նրա փաստաբանը՝ Էրիկ Բեգլարյանը նշել էր, որ Հովհաննեսը Միքայելի ինքնաձիգը կատակով փորձել է վերցնել եւ հենց այդ քաշքշոցի ժամանակ էլ արձակվել է մահացու կրակոցը:

Հիշեցնենք, որ Հովհաննես Հարությունյանը զոհվել էր մարտի 17-ին՝ ժամը 17:30-ի սահմանում, ՊԲ հարավային ուղղությամբ տեղակայված զորամասերից մեկի պահպանության տեղամասում:
