Վերաքննիչը մերժել է Երեւանի կենտրոնում տաքսու վարորդին սպանելու մեջ մեղադրվողի պաշտպանի բողոքը

Վերաքննիչ դատարանը մերժել է Երեւանի կենտրոնում հունիսի 1-ին տաքսու վարորդ Արսեն Խանամիրյանի սպանության մեջ մեղադրվող եւ 9 տարվա ազատազրկման դատապարտված Վահրամ Վերանյանի պաշտպանի բողոքը:  Վերաքննիչ դատարանն անփոփոխ է թողել Երևանի Կենտրոն եւ Նորք-Մարաշ վարչական շրջանների ընդհանուր իրավասության դատարանի 2017 թվականի ապրիլի 4-ի դատավճիռը  եւ մերժել պաշտպան Հովիկ Արսենյանի վերաքննիչ բողոքը:

Նշենք, որ պաշտպանը պահանջում էր ամբողջությամբ բեկանել Երեւանի Կենտրոն եւ Նորք-Մարաշ վարչական շրջանների ընդհանուր իրավասության դատարանի`Վահրամ Վահանի Վերանյանի նկատմամբ կայացված դատավճիռը: Պաշտպանը պահանջում էր նաեւ փոխել իր պաշտպանյալին առաջադրված մեղադրանքը՝  ՀՀ քր.օր. 112 հոդ. 1-րդ մասը փոխարինել 2-րդով՝ Սպանությունը:

Նշենք, որ Վահրամ Վերանյանը մեղավոր է ճանաչվել ՀՀ քրեական օրենսգրքի 104-րդ հոդվածի 1-ին մասով՝ սպանություն:

Մեղադրողը միջնորդել էր ամբաստանյալին դատապարտել 10 տարվա ազատազրկման:

Նշենք, որ Արսեն Խանամիրյանի սպանության մեջ մեղադրվող Վահրամ Վերանյանը ցուցմունք էր տվել, որ Արսենն իրեն դեպքի օրը հետապնդել է: NEWS.am-ի հետ զրույցում Վահրամ Վերանյանի պաշտպան Հովիկ Արսենյանը նշել էր, որ Արսենը բազմաթիվ անգամներ հետապնդել է Վահրամին, այդ օրն էլ Վահրամն իր երեխային մանկապարտեզ է տարել, հետո ընկերոջ հետ գնացել է մեքենան վերանորոգելու, նկատել է, որ էլի հետապնդում է Արսենն իրեն: Նախքան այդ Արսենը Վարամի հետ հաշվեհարդար էր տեսել, այնպես էր ծեծել, որ նրան ուղեղի ցնցումով հիվանդանոց էին տեղափոխել: Բարոյազրկել էր Վահրամին: Վահրամի ընկերուհուն էր զանգել սպառնացել, թե հեսա խռխռոցը կլսես: Դրա համար Վահրամը փորձել է վրեժխնդիր լինել Խանամիրյանի նկատմամբ, պատժել, փայտը ձեռքին է մոտեցել նրան: Արսենը փայտը ձեռքից խլել է, Վահրամը հասկացել է, որ վերջը գալու է, իր մոտն եղած դանակն է գործադրել: Իսկ տուժող կողմի պնդումները, որ սպանվածի կինն ու Վահրամ Վերանյանը, որ նախկինում սիրային կապի մեջ են եղել, մինչեւ վերջերս հանդիպել են, զրուցել հեռախոսով, պաշտպանի խոսքով, իրականությանը չեն համապատասխանում: Նրա պնդմամբ` սպանվածի կինն է պարբերաբար զանգահարել Վահրամ Վերանյանին, հետապնդել նրան:

Նշենք, որ սպանված 48-ամյա Արսեն Խանամիրյանի հարազատները պատահածում մեղադրում են նրա կնոջը: Ըստ մահացածի եղբոր՝ կինը՝ Ա. Դ-ն, արտաամուսնական կապի մեջ է եղել սպանության մեջ մեղադրվող 26-ամյա Վահրամ Վերանյանի հետ:

Արսենի եղբայրը NEWS.am-ին պատմել էր, որ սպանությունից առաջ նրա եւ Վահրամի միջեւ ծեծկռտուք է եղել կնոջ պատճառով, Վահրամը հիվանդանոց է տեղափոխվել, Արսենը՝ Ոստիկանություն: Ընտանիքի անդամներն ասում են՝ Արսենը կնոջ հետ շարունակել է ապրել միայն հանուն իրենց 3 երեխաների: Սպանությունից հետո կինը տեղափոխվել է այլ վայր բնակության՝ երեխաներից 2-ին իր հետ տանելով:

Վահրամ Վերանյանին մեղադրանք է առաջադրվել ՀՀ ՔՕ 104-րդ հոդվածի 1-ին մասով՝ Սպանությունը:
