Կապանում կենցաղային հարցերի պատճառով 18-ամյա տղան ծեծի է ենթարկվել 12-ամյա երեխային

ՀՀ քննչական կոմիտեի Սյունիքի մարզային քննչական վարչությունում քննվող քրեական գործով մեղադրանք է առաջադրվել` 12-ամյա տղայի նկատմամբ բռնություն գործադրելու համար։
2017թ. հունիսի 5-ին հաղորդում է ստացվել առ այն, որ Կապան քաղաքի բակերից մեկում ծեծի է ենթարկվել 2005թ. ծնված երեխա, որի ընթացքում նրան պատճառվել են մարմնական վնասվածքներ:
Դեպքի առթիվ հարուցվել է քրեական գործ՝ ՀՀ քրեական օրենսգրքի 117-րդ հոդվածով, որով նախաքննությունն իրականացվում է ՀՀ ՔԿ Սյունիքի մարզային քննչական վարչությունում:
Նախնական քննությամբ ձեռնարկված անհրաժեշտ քննչական գործողությունների արդյունքում փաստական տվյալներ են ձեռք բերվել, որ անչափահասը մարմնական վնասվածքներ ստացել է 2017թ. հունիսի 5-ին՝ ժամը 17:30-ի սահմաններում տեղի ունեցած վիճաբանության ժամանակ՝ 18-ամյա երիտասարդի կողմից: Վիճաբանությունն առաջացել է կենցաղային հարցերի շուրջ, ինչի ժամանակ էլ 18-ամյա երիտասարդը բռնություն է գործադրել անչափահաս տղայի նկատմամբ՝ ձեռքով սեղմել պարանոցը, քաշքշել, հարվածներ հասցրել նրա մարմնի տարբեր մասերին` գլխի, կրծքավանդակի շրջանին պատճառելով մարմնական վնասվածքներ:
Հաշվի առնելով ՀՀ Սահմանադրական դատարանի 2016 թվականի դեկտեմբերի 20-ի ՍԴՈ-1333 որոշմամբ արտահայտած իրավական դիրքորոշումը, ըստ որի՝ «…մինչև տասնչորս տարին չլրացած երեխաների,…հաշտվելը կասկածյալի, մեղադրյալի հետ հիմք չէ՝ գործի վարույթը կարճելու և քրեական հետապնդումը դադարեցնելու համար, ինչը երաշխիք է այս խոցելի կատեգորիայի անձանց իրավունքների և շահերի դատական պաշտպանության համար»՝ նախնական քննությամբ ձեռք բերված բավարար ապացույցների համակցությամբ՝ քննիչը 18-ամյա երիտասարդին մեղադրանք է առաջադրել՝ ՀՀ քրեական օրենսգրքի 117-րդ հոդվածով։ Վերջինիս նկատմամբ որպես խափանման միջոց է կիրառվել ստորագրություն չհեռանալու մասին:
Նախաքննությունը շարունակվում է, ձեռնարկվում են բոլոր միջոցները երեխայի լավագույն շահը ապահովելու համար:
