Քաղաքացու ընտրական իրավունքի ազատ իրականացմանը խոչընդոտելու դեպքի առթիվ հարուցվել է քրգործ

18.05.2017թ. թիվ 7 տարածքային ընտրական հանձնաժողովի նախագահ Վ. Խաչատրյանը ՀՀ գլխավոր դատախազին հասցեագրված գրությամբ հայտնել էր, որ «Ելք» կուսակցությունների դաշինքի վստահված անձի դիմումի հիման վրա 16.05.2017թ. կատարվել է 14.05.2017թ. Երեւանի ավագանու ընտրությունների 7/51 ընտրական տեղամասի քվեարկության արդյունքների վերահաշվարկ, որի արդյունքում պարզվել է, որ թիվ 7/51 ընտրական տեղամասում անվավեր քվեաթերթիկների փաթեթում առկա են մի շարք քվեաթերթիկներ, որոնց վրայից անհետացել էր կողմ քվեարկած նշումի թանաքանյութը:
20.05.2017թ. ՀՀ քրեական դատավարության օրենսգրքի 180-181-րդ հոդվածների կարգով նյութեր նախապատրաստելու հանձնարարությամբ թիվ 7 տարածքային ընտրական հանձնաժողովի նախագահի գրությունը ուղարկվել էր ՀՀ կառավարությանն առընթեր ՀՀ ոստիկանության Երեւան քաղաքի վարչության Մալաթիայի բաժին:
Նյութերի նախապատրաստման ընթացքում պարզվել էր, որ այն քվեաթերթիկները, որոնց վրայից ենթադրաբար անհետացել էր կողմ քվեարկած նշումի թանաքանյութը 37-ն են, որոնցից 15-ը քվեարկված է եղել Հայաստանի հանրապետական կուսակցության, 17-ը՝ «Ելք» կուսակցությունների դաշինքի, իսկ 5-ը՝ «Երկիր ծիրանի» կուսակցության օգտին:
Վիճելի քվեաթերթիկների վրայից կողմ քվեարկած նշումի ջնջման կամ անհետացման մեխանիզմը եւ հանգամանքները պարզելու նպատակով վարույթն իրականացնող մարմնի կողմից 24.05.2017թ. նշանակվել է դատատեխնիկական եւ դատաքիմիական համալիր փորձաքննություն:
Փորձագետի՝ 09.06.2017թ. եզրակացության համաձայն. «Փորձաքննությանը ներկայացված քվեաթերթիկների մակերեսներին առկա «V»- ձեւ նշանների եւ գրառումների ուրվագծերը կատարվել են գրող գործիքի միջոցով, սակայն դրանց հետագա անհետացման պատճառների պարզաբանման, ներկանյութի բաղադրության վերաբերյալ գիտական հիմնավորված մեթոդներ ու գրականություն ՀՀ ոստիկանության ՓՔ վարչությունում առկա չեն, ուստի առաջադրված հարցերին, թե ինչ նյութերով են կատարվել այդ նշումները եւ ինչ պատճառով կարող էին դրանք անհետանալ, պատասխանել հնարավոր չէ: Նույն պատճառով հնարավոր չէ պարզել նաեւ դրանց կատարման վաղեմությունը:»
Վերը նշված հանգամանքները պարզելուն ուղղված անհրաժեշտ հնարավոր բոլոր քննչական եւ այլ դատավարական գործողությունները կատարելու նպատակով Երեւան քաղաքի Մալաթիա-Սեբաստիա վարչական շրջանի դատախազության դատախազի կողմից 20.06.2017թ. ՀՀ քրեական օրենսգրքի 149-րդ հոդվածի 1-ին մասի հատկանիշներով հարուցվել է քրեական գործ, որի նախաքննությունը հանձնարարվել է ՀՀ հատուկ քննչական ծառայությանը:
