Գործարարների շահերի պաշտպանության խնդիր կա. տնտեսագետը՝ կառավարության նախաձեռնության մասին

Այն դեպքում, երբ  դատական համակարգը  սկսում է իր ֆունկցիաները կատարելու տեսանկյունից թերանալ, ուրեմն միջնորդ օմբուդսմենների, հաշտարարների և այլ կարգավորող օրենքների անհրաժեշտություն է սկսում առաջանալ:

Այս մասին Tert.am-ի հետ զրույցում ասաց տնտեսագետ Վիլեն Խաչատրյանը` անդրադառնալով գործարար միջավայրի բարելավման և բիզնեսի շահերի պաշտպանության վերաբերյալ ՀՀ կառավարության  ծրագրին, համաձայն որի՝ նախատեսվում է մինչև 2017 թվականի ավարտը մշակել «Գործարարների շահերի պաշտպանի մասին» ՀՀ օրենքի նախագիծ և այն ներկայացնել ՀՀ Ազգային ժողով:

«Բացի այն, որ դատական համակարգը սկսում է իր ֆունկցիաները կատարելու տեսանկյունից թերանալ, նաև մշակվում և փոփոխվում են մի շարք օրենքներ, այդ օրենքների հետ կապված սկսում են թրեյնինգներ անել, խորհրդատվական  ծառայություններ մատուցել:Երբ նայում ես այդ ամբողջ շղթային, նկատում ես, որ  գործարարների շահերի պաշտպանի մասին օրենքներն անհրաժեշտ են, որ գործարարը խուսափի դատական համակարգի  հետ առնչվելուց»,-ասաց  տնտեսագետը:

Նրա խոսքով՝այդ ամենի միջնորդ օղակը, որպես այդպիսին, բիզնես օմբուդսմենի գաղափարն է, որպեսզի  տվյալ օղակի միջոցով իր խնդիրներն ու հարցը լուծի:

«Չեմ կարծում, որ միայն այդ օրենքի բացակայությամբ է պայմանավորված մեր բիզնես միջավայրի վատ վիճակում լինելը, բայց, այնուամենայնիվ, գործարարների շահերի պաշտպանության խնդիր գոյություն ունի,  օրենքների մեջ կան տարընթերցումներ, ձևակերպումներ,որ միանշանակ չեն ընկալվում հարցերը»,-ասաց Խաչատրյանը, հավելելով, որ  նման հարցերի  մեկնաբանության ժամանակ նման մարմինների կամ նման շահերի պաշտպանության անհրաժեշտություն լինում է:

Նշենք, որ Գործարար միջավայրի բարելավման և բիզնեսի շահերի պաշտպանության ոլորտում ՀՀ կառավարությունը նախատեսում է  մինչև 2017 թվականի ավարտը մշակել «Գործարարների շահերի պաշտպանի մասին» ՀՀ օրենքի նախագիծ և այն ներկայացնել ՀՀ Ազգային ժողով ու մինչև 2018 թվականի ավարտը՝ որպես գործարարների խախտված կամ վիճարկվող իրավունքների և օրինական շահերի պաշտպանության և վեճերի լուծման այլընտրանքային արդյունավետ միջոց ներդնել՝ գործարարների շահերի պաշտպանի ինստիտուտ:
