Սամվել Բաբայանի մասին տվյալները որոշակի առումով արժանահավատ չեն։ Այս մասին, այսօր՝ հունիսի 25-ին, «Ժառանգություն» կուսակցության 11-րդ համագումարի ժամանակ լրագրողների հետ զրույցում նշել է ՀՀ պաշտպանության նախկին նախարար Սեյրան Օհանյանը՝ անդրադառնալով Սամվել Բաբայանի դեմ հարուցված քրեական գործի ընթացին։

«Մենք հետեւել ենք գործին, իմ տեսակետը մնում է նույնը, ես մեծ հարգանք եմ տածում եւ Սամվել Բաբայանի եւ իմ բոլոր հին մարտական ընկերների նկատմամբ, ովքեր կանգնած են եղել Հայաստանի եւ Արցախի ձեւավորման ակունքներում, ընդ որում մարտական գործողությունների ժամանակ։ Ես հավասարապես հարգում եմ շարժման սկզբից մինչեւ հիմա խրամատում կանգնած մեր զինվորներին։ Հարցն այն է, որ մենք Սամվել Բաբայանի հետ մենք առնչվել ենք փաստաբանի միջոցով։ Լավ կլիներ ավելի լայն տեղեկություններ տրվեր գործի վերաբերյալ, քանի որ այդ լայն տեղեկությունները մենք չունենք եւ  թվում է՝ որոշակի առումով արժանահավատ չեն այն տվյալները, որ կան նրա մասին»,-ընդգծեց Սեյրան Օհանյանը։

Հիշեցնենք, որ Սամվել Բաբայանը ձերբակալվել էր մարտի 20-ին Հայաստանի Հանրապետություն «Իգլա» տեսակի զենիթա-հրթիռային համալիր տեղափոխելու փաստի առթիվ հարուցված քրեական գործի շրջանակներում։

Սամվել Բաբայանին մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 235-րդ հոդվածի 2-րդ մասով (ապօրինի կերպով հրազեն, բացի ողորկափող հրազենից եւ դրա փամփուշտներից, ռազմամթերք, ակոսափող հրազենի փամփուշտներ, պայթուցիկ նյութեր կամ պայթուցիկ սարքեր ձեռք բերելը, իրացնելը, պահելը, փոխադրելը կամ կրելը, որոնք կատարվել են մի խումբ անձանց կողմից նախնական համաձայնությամբ) եւ 235.1-րդ հոդվածի 2-րդ մասի 1-ին կետով (խիստ ներգործող, թունավոր, պայթուցիկ, ռադիոակտիվ նյութերի, ճառագայթման աղբյուրների, միջուկային նյութերի, հրազենի կամ նրա բաղկացուցիչ մասերի, բացի ողորկափող որսորդական հրազենից եւ դրա փամփուշտներից, պայթուցիկ սարքերի, ռազմամթերքի, զանգվածային ոչնչացման զենքի, դրա տեղափոխման միջոցների, այլ զինամթերքի, ռազմական տեխնիկայի, զանգվածային ոչնչացման զենք կամ դրա փոխադրման հրթիռային համակարգեր ստեղծելու համար օգտագործվող այլ նյութերի կամ սարքավորումների, միջուկային, քիմիական, կենսաբանական կամ զանգվածային ոչնչացման այլ զենքի կամ երկակի նշանակության ապրանքների, ռազմավարական տեսակետից կարեւոր հումքային ապրանքների կամ մշակութային արժեքների մաքսանենգությունը, որը կատարվել է մի խումբ անձանց կողմից նախնական համաձայնությամբ)։

Ավելի ուշ Նրան առաջադրված մեղադրանքներից հանվել է  ՀՀ ՔՕ 235.1-րդ հոդվածի 2-րդ մասի 1-ին կետը ՝ Ռազմամթերքի մաքսանենգությունը, փոխարենը նոր մեղադրանք է առաջադրվել մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 190-րդ հոդվածի 1-ին մասի հատկանիշներով՝ փողերի լվացում։
