ՀՀ դատարաններում կարգադրիչների կողմից փաստաբաններին զննության ենթարկելը մտահոգությունների լուրջ ալիք է բարձրացրել ՓՊ-ում :

Երևույթը քննարկման առիթ է դարձել ինչպես լրատվական տարբեր հարթակներում, այնպես էլ սոցիալական ցանցերում: Թեմայի շուրջ իրենց տեսակետն են հայտնել թե՛ ՓՊ նախագահը, և թե՛ այն փաստաբանները, ովքեր պնդում են, որ իրենց հանդեպ նման վերաբերմունքը ոչ այլ ինչ է, քան անձնական խուզարկություն:

Past.am-ը զրուցել է ԱԺ «Ելք» խմբակցության պատգամավոր, իրավաբան Արտակ Զեյնալյանի հետ.


«Կարծում եմ՝ պայուսակների խուզարկությունն անթույլատրելի է և՛ փաստաբանի անձնական կյանքի միջամտության, և՛ փաստաբական գաղտնիքի տեսանկյունից»,-ասաց պատգամավորը ընդգծելով, որ իրավական պետության սկզբունքների իրագործված լինելու առումով երկիրը կաղում է:


Ըստ Ա. Զեյնալյանի, փաստաբանների հանդեպ նման մոտեցումը պարզապես խտրական վերաբերմունք է.

«Հավանաբար նկատել եք, որ նման վերաբերմունք չի ցուցաբերվում դատախազների նկատմամբ: Սա խտրական վերաբերմունք ու թշնամական ընկալում է պաշտպանական կողմից »:


Ինչ վերաբերում է այն տեսակետներին, թե պայուսակների զննումը կատարվում է զուտ անվտանգության ապահովման նկատառումներից ելնելով, ապա պատգամավորը նշում է, որ նմանօրինակ միջոցառումների իրականացումը հասկանալի կլինեին, եթե իրականացվեին մնացած բոլոր մասնակիցների նկատմամբ, բայց դարձյալ ո՛չ անձնական կյանքի միջամտությամբ.

«Հարկավոր է դնել համապատասխան սարքավորումներ: Անձնական զննություն իրականացնելը ես լուրջ ու չարդարացված միջամտություն եմ համարում: Երբ զննություն չի իրականացվում դատախազների նկատմամբ, այստեղից ենթադրվում է, որ դատախազությունն ու դատարանը նույնականացված են, նրանք մեկ կողմում են»:
