Տեսագրումը մեծ խթան կարող է հանդիսանալ խոշտանգումների դեմ պայքարում. ՀՀ գլխավոր դատախազության ներկայացուցիչ

ՀՀ գլխավոր դատախազությունը կարևոր է համարում քննչական գործողությունների ժամանակ տեսագրում իրականացնելը, քանի որ այն կարող է կանխարգելել խոշտանգումները և բավարար ապացույց հանդիսանալ հետագա քննչական գործողությունների համար: «Արմենպրես»-ի հաղորդմամբ՝ հունիսի 26-ին Խոշտանգումների զոհերի աջակցության միջազգային օրվան նվիրված միջոցառման ժամանակ այս մասին նշեց ՀՀ գլխավոր դատախազության հատկապես կարևոր գործերով քննության վարչության պետի տեղակալ Կարեն Բիշարյանը: Նրա խոսքով` հունիսի 23-ին ՀՀ դատախազության կոլեգիայի ընդլայնված նիստին հրավիրվել էին նաև քննչական մարմինները, որտեղ նրանց առաջարկվել է տեսագրումը առավել հաճախ օգտագործել պրակտիկայում:
«ՄԱԿ-ի խոշտանգումների դեմ կոմիտեի հանձնարարականում շատ կարևոր շեշտադրում է արված` խոշտանգումները կանխարգելելու և դրանց վերաբերյալ գործերով պատշաճ ապացույցներ ձեռք բերելու համար կասկածյալների, մեղադրյալների մասնակցությամբ կատարվող դատավարական, քննչական գործողությունները պետք է տեսագրել: Բացի այդ, ՄԱԿ-ն առաջարկել է օրենսդրական և ֆինանսական աջակցություն ցուցաբերել, որպեսզի արգելանքի տակ պահվող վայրերը, քննչական գործողությունների սենյակները ևս զինվեն տեսագրվող սարքերով: Սա կարևոր խնդիր է, որը պետք է հրատապ լուծում ստանա»,- ասաց Բիշարյանը:
Նրա խոսքով` ՀՀ դատախազությունը չունի օրենսդրական և ֆինանսական լիազորություններ, ուստի ընդլայնված նիստի ժամանակ քննչական մարմինների ղեկավարներին առաջարկվել է լուծում:
«Հայեցողական կարգով քննիչին այդ իրավունքը վերապահվում է` հարցաքննությունը և այլ քննչական գործողությունը տեսագրել: Մենք առաջարկել ենք, որպեսզի քննչական մարմինների ղեկավարները հատուկ ուշադրություն դարձնեն այս հանգամանքին և առավել հաճախ քննչական պրակտիկայում կիրառեն քննչական գործողությունների տեսագրող սարքեր, հատկապես, քննչական գործողությունների կատարման, ինչպես նաև կասկածյալի հարցաքննության ընթացքում»,- ասաց Բիշարյանը:
Ըստ ՀՀ գլխավոր դատախազության հատկապես կարևոր գործերով քննության վարչության պետի տեղակալի` ուսումնասիրությունները ցույց են տալիս, որ հիմնականում խոշտանգման մասին հաղորդումները տալիս են այն անձինք, ովքեր քննության որևէ փուլում խոստովանական ցուցմունք են տվել և հետագայում, փորձելով վիճարկել իրենց խոստովանական ցուցմունքը, ներկայացնում են հաղորդում, որտեղ մատնանշում են, որ, իբր, խոստովանական ցուցմունքը տվել են խոշտանգման ազդեցության տակ, ուստի տեսագրումը անհրաժեշտ է նման դեպքերը բացառելու և ապացույցներ ունենալու համար:
Բիշարյանը հավելեց, որ կոլեգիայի ընդլայնված նիստում հատուկ ուշադրություն է դարձվել նաև Հայաստանի դեմ Եվրոպական դատարանի վճիռներում արձանագրված խախտումներին, որոնք վերաբերում են Կոնվենցիայի 3-րդ հոդվածի կիրառմանը:
