Լոռու մարզի անչափահաս բնակչուհին հայտարարել է, որ նույն մարզի մի բնակիչ իրենց տան ննջարանում բռնաբարել է իրեն

ՀՀ քննչական կոմիտեի ներքին անվտանգության վարչությունում ահազանգ է ստացվել՝ բռնաբարության դեպքի առթիվ Լոռու մարզային քննչական վարչությունում քննվող քրեական գործի վարույթը կարճելու համար գումար պահանջելու վերաբերյալ։ 

ՀՀ ՔԿ նախագահի հանձնարարությամբ ներքին անվտանգության վարչությունում անմիջապես կատարվել են նախնական ուսումնասիրություններ։ Արդյունքում պարզվել է, որ 2017թ. մայիսի 6-ին ոստիկանությունում  Լոռու մարզի անչափահաս բնակչուհուց հաղորդում է ստացվել, որ նույն մարզի մի բնակիչ իրենց տան ննջարանում,  բռնություն գործադրելով, բռնաբարել է իրեն:  

Անչափահաս աղջկա մայրը նյութերի նախապատրաստման ընթացքում հայտնել է, որ տղան, ով նույնպես անչափահաս է՝ ծնված 2000թ., իր դստեր ննջարանում գիշերել է իր թույլտվությամբ և հերքել բռնաբարության հանգամանքը։ Ըստ մոր հայտարարության՝ անչափահասների միջև սեռական հարաբերությունը տեղի է ունեցել փոխադարձ համաձայնությամբ։ 

ՀՀ ՔԿ Լոռու մարզային քննչական վարչությունում հարուցվել է քրեական գործ՝ ՀՀ քրեական օրենսգրքի 138-րդ հոդվածի 2-րդ մասի 3-րդ և 7-րդ կետերի հատկանիշներով և ձեռնարկվել անհրաժեշտ քննչական գործողություններ՝ դեպքի հանգամանքները պարզելու, օբյեկտիվ, բազմակողմանի և լրիվ հետազոտումն ապահովելու ուղղությամբ, նշանակվել մի շարք փորձաքննություններ: Անչափահաս աղջիկը ճանաչվել է տուժող, իսկ մայրը՝ տուժողի ներկայացուցիչ։ 

Տուժողի նկատմամբ նշանակված դատաբժշկական փորձաքննության եզրակացությամբ՝ սեռական հարաբերության մասին վկայող տվյալներ չեն հայտնաբերվել, սակայն աղջկա մարմնի վրա, թևերին հայտնաբերվել են  կապտուկներ, քերծվածքներ։ Վնասվածքներ են հայտնաբերվել նաև տղայի պարանոցի հատվածում։ Համեմատական հետազոտության համար վերցվել են փորձանմուշներ և նշանակվել համալիր փորձաքննություն, որի եզրակացությունը դեռ չի ստացվել։  

Նախաքննության ընթացքում տուժողը մի քանի անգամ փոխել է ցուցմունքը, իսկ տուժողի ներկայացուցիչը հայտարարել է, թե, իբր, գործը կարճելու համար գումար են պահանջել։ Ներքին անվտանգության վարչությունում կատարված ուսումնասիրության ընթացքում անչափահաս աղջկա մայրը պնդել է, թե գործի վարույթը կարճելու համար կաշառք  են պահանջել տղայի մորեղբորից, ինչն իրենց բացատրություններում հերքել են անչափահա տղան և նրա մորեղբայրը։  

Նկատի ունենալով, որ տուժողի ներկայացուցչի գրավոր հայտարարությունն առերևույթ պարունակում է հանցագործության հատկանիշներ՝ ՀՀ ՔԿ ներքին անվտանգության վարչության նախնական ուսումնասիրությունների արդյունքներն ուղարկվել են ՀՀ հատուկ քննչական ծառայություն՝ ըստ քննչական ենթակայության։  

Ծանուցում. Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
