Քրեական գործ` առանձնապես խոշոր չափերի խարդախության և վաշխառության փաստերով

ՀՀ հատուկ քննչական ծառայությունում քրեական գործեր են հարուցվել առանձնապես խոշոր չափերի խարդախության և վաշխառության դեպքերի վերաբերյալ ՀՀ ԿԱ պետական եկամուտների կոմիտեի հարկային ծառայության աշխատակիցներ Ա. Ե.-ի և Խ. Հ.-ի կողմից տրված հաղորդումների հիման վրա:  

Այսպես,ՀՀ ԿԱ ՊԵԿ հարկայինտեսուչ Ա. Ե.-ն հաղորդում է տվել այն մասին, որ նույն կառույցի մեկ այլ հարկային տեսուչ Խ. Հ.-ն իրեն տոկոսով գումարներ է տվել` զբաղվելով վաշխառությամբ: Մասնավորապես, վերջինս 2008 թ.-ի դեկտեմբերի 10-ից մինչև 2014թ.-ի օգոստոսի 10-ը` տարբեր ժամանակահատվածներում, իրեն տվել է ընդհանուր առմամբ` 4.500.000 ՀՀ դրամ` սկզբում ամսական 10, ապա` 3 տոկոս տոկոսադրույքով: Վաշխառության հիշյալ դեպքի առթիվ Հատուկ քննչական ծառայությունում  հարուցվել է քրեական գործ ՀՀ քրեական օրենսգրքի 213-րդ հոդվածի 1-ին մասով:  

Հարկային տեսուչ Խ. Հ.-ն էլ, իր հերթին, Հատուկ քննչական ծառայությունում քննվող քրեական գործի նախաքննության ընթացքում ցուցմունքներ է տվել, որ Ա. Ե.-ն է իր վստահությունը չարաշահելու միջոցով իրենից առանձնապես խոշոր չափերի գումար հափշտակել: Ըստ Խ. Հ.-ի` 2011 թվականի մարտի 10-ին Ա. Ե.-ն, չարաշահելով իր վստահությունը, կարճ ժամկետներում վերադարձնելու պայմանով իրենից վերցրել է 9.000.000 ՀՀ դրամ, սակայն խոստումը չի կատարել և խարդախությամբ հափշտակել է այն: Հանցագործության հիշյալ դեպքի առթիվ հարուցվել է քրեական գործ ՀՀ քրեական օրենսգրքի 178-րդ հոդվածի 3-րդ մասի 1-ին կետով:  

Բազմակողմանի, լրիվ և օբյեկտիվ քննությունն ապահովելու անհրաժեշտությամբ պայմանավորված` վերը նշված երկու քրեական գործերը միացվել և քննվում են մեկ վարույթում:  

Կատարվում է նախաքննություն:

Ծանուցում.ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ,քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով`դատարանի` օրինական ուժի մեջ մտած դատավճռով:
