ՏՄՊՊՀ-ն պատժեց «Կանդելլա» ընկերությանը` «menu.am» կայքի և ապրանքային նշանի սեփականատիրոջ նկատմամբ անբարեխիղճ մրցակցության համար

ՀՀ տնտեսական մրցակցության պաշտպանության պետական հանձնաժողովին դիմում- բողոք է ներկայացրել առաքման ծառայություններ իրականացնող «menu.am» ապրանքային նշանի սեփականատեր «Ինտերնետ  Փրոջեքթս» ընկերությունը՝ ընդդեմ «Կանդելլա» ՍՊԸ-ի: «Արմենպրես»-ի հաղորդմամբ, բողոքի համաձայն, «Կանդելլա» ՍՊԸ-ին է պատկանում նույնանման ծառայություններ իրականացնող «buy.am» կայքը, սակայն, ընկերությունը գրանցել է նաև մեկ տառի տարբերությամբ՝  «menyu.am» դոմենը, որը ուղղորդում է դեպի  «buy.am»: Այսինքն՝ սպառողը ինտերնետային էջում հավաքելով «menyu.am», մեխանիկորեն հայտնվում է «buy.am»-ում և պատվերներ է կատարում այդ կայքի միջոցով:

ՏՄՊՊՀ նախագահ Արտակ Շաբոյանի խոսքով` բազմաթիվ տնտեսավարողներ այսօր տնտեսական գործունեություն են իրականացնում ինտերնետ կայքերի միջոցով: «Պարզվում է,  կան տնտեսավարողներ, որոնք փորձում են պահանջված ինտերնետային կայքերը նմանակել, ինտերնետային կայքեր են գրանցում անբարեխիղճ ճանապարհով եւ փորձում են իրենց մրցակիցներից հաճախորդներ ներգրավել»,-ասաց նա:

Հանձնաժողովը վարույթի ընթացքում պարզել է, որ «Կանդելլայի» նման վարքագիծը կարող է սպառողների մոտ շփոթություն առաջացնել «menu.am»-ի սպառողների մոտ, քանի որ շատերը, գովազդային հոլովակներում կամ այլ աղբյուրներից տեղեկացել են «menu.am» կայքի մասին, մտաբերել են այն հայերեն, որպես  «Մենյու. Էյ Էմ»: Շատ մեծ է հավանականությունը, որ օնլայն ընկերության ծառայություններին դիմելու նպատակով «menu.am» դոմենի փոխարեն հավաքեն  «menyu.am» և հայտնվեն «buy.am» հասցեով կայքում: Ակնհայտ է, որ «menyu.am» կայքը շփոթության աստիճան նման է «menu.am» դոմենին և ապրանքային նշանին, որոնք հայերենում հնչում են ամբողջությամբ նույնական: 

«Ինտերնետ  Փրոջեքթս» ընկերության ներկայացուցիչ, իրավաբան Թաթուլ Խուվերդյանի խոսքով` հանձնաժողովի վարչական վարույթի ընթացքում «buy.am» կայքը շարունակել է  իրականացնել խախտումը:

ՏՄՊՊՀ որոշմամբ, «menyu.am» կայքի օգտագործումը և այն «buy.am» կայքին ուղղորդումը հանդիսանում է «menu.am» կայքի և ապրանքային նշանի սեփականատիրոջ նկատմամբ անբարեխիղճ մրցակցության դրսևորում, ինչի համար «Կանդելլա» ՍՊԸ-ն ստացավ նախազգուշացում՝ խախտումը սեղմ ժամկետում վերացնելու հանձնարարականով:
