Իրավապաշտպան. «Կրոնի ազատության մասին» նոր օրենքը խտրական մոտեցումներ ունի»

Հելսինկյան Քաղաքացիական Ասամբլեայի Վանաձորի գրասենյակը գտնում է, որ «Խղճի ազատության և կրոնական կազմակերպությունների մասին» օրենքի նախագիծն ունի բազմաթիվ խնդրահարույց դրույթներ, որոնք հակասում են մարդու իրավունքների հանրաճանաչ սկզբունքներին, հիմքեր են ստեղծում տարբեր կրոնական ուղղությունների նկատմամբ խտրական վերաբերմունք սերմանելու, ինչպես նաև նրանց իրավունքների սահմանափակման համար։
 
Այս մասին Past.am-ի հետ զրույցում ասաց գրասենյակի ղեկավար, իրավապաշտպան Արթուր Սաքունցը:
 
Նշենք, որ հունիսի 1–ին ՀՀ Արդարադատության նախարարության իրավական ակտերի նախագծերի հրապարակման միասնական կայքում հանրային քննարկման է դրվել նախագիծը: Դրա առթիվ որպես իրավապաշտպան կազմակերպություն, «կարևորելով նախագծով կարգավորման ենթակա հարաբերությունների դերը և նշանակությունը ժողովրդավարական, իրավական պետության կայացման հարցում», Հելսինկյան Քաղաքացիական Ասամբլեայի Վանաձորի գրասենյակը պատրաստել է առաջարկությունների փաթեթ, որը 2017 թ. հունիսի 23–ին ուղարկվել է ՀՀ Արդարադատության նախարարություն:
 
«Օրենքով, ըստ էության, բացի Առաքելական եկեղեցուց, մյուս եկեղեցիների և կրոնական կազմակերպությունների համար արտերկրից ֆինանսավորման արգելք է դրված, ֆինանսական աղբյուրները սահմանափակվում են, և միայն Առաքելական եկեղեցին կարող է դրսից ֆինանսավորվել»,– ասաց Սաքունցը՝ հավելելով. «Անհայտ է, որ այս օրենքով կրոնական կազմակերպություների իրավունքների սահմանափակում է նախատեսվում և առավելություն է տրվում Առաքելական եկեղեցուն»:
 
Կազմակերպությունն առաջարկել է օրենքի նախագծից հանել իրենց բնույթով խտրական կարգավորումները։ Մասնավորապես, նախևառաջ առաջարկվել է քննարկվող նախագծի կարգավորման առարկա դարձնել նաև Հայաստանյայց Առաքելական Սուրբ Եկեղեցու հետ կապված հարաբերությունները, «քանի որ օրենքի նախագիծը կարգավորում է հենց մտքի, խղճի, կրոնի ազատությունը, իսկ այս օրենքի նախագծով այդ հարաբերությունները չկարգավորելը խտրականություն է, և Հայաստանյայց Առաքելական Սուրբ Եկեղեցու ազգային եկեղեցի լինելու հանգամանքը չի կարող այլ կրոնների/համոզմունքների համեմատ առավել լայն իրավունքների և ազատությունների սահմանման հիմք հանդիսանալ»:
 
Կազմակերպությունն անդրադարձել է նաև կրոնական կազմակերպությունների իրավունքների սահմանափակման հիմքերին և հաշվի առնելով Մարդու իրավունքների եվրոպական դատարանի նախադեպային իրավունքը՝ առաջարկել է սահմանափակման հիմքերը համապատասխանեցնել Մարդու իրավունքների եվրոպական կոնվենցիայի պահանջներին։ ՀՔԱ Վանաձորի գրասենյակը կարևորում է կրոնական կազմակերպությունների դատական իրավասուբյեկտությունը և մի շարք միջազգային իրավակարգավորումների լույսի ներքո առաջարկել է ապահովել կրոնական կազմակերպությունների դատական պաշտպանության իրավունքը և ընդգծել է պետության դերը նշված պարտավորության շրջանակներում։ Ի թիվս այլնի, Կազմակերպությունը ներկայացրել է մի շարք առաջարկություններ, որոնք վերաբերում են կրոնական համոզմունքները չբացահայտելու, կրոնական կազմակերպությունների ֆինանսական աջակցություն ստանալու իրավունքների ապահովմանը և այլն։
