1in.am\ Սյունիքի մարզի ընդհանուր իրավասության դատարանում Արսեն Սարդարյանի նախագահությամբ ավարտվել է զինծառայող Հ.-ի գործով դատական քննությունը:

Ըստ մեղադրանքի՝ պարտադիր զինվորական ծառայության մեջ գտնվող Հ.-ն Նոր տարվա գիշերը՝ 2016 թվականի դեկտեմբերի 31-ին, գիշերվա ժամը 4-ն անց 30-ի սահմաններում զորանոցի ննջարանում, «սեռական կրքերին խաթարված ձևով հագուրդ տալու նպատակով իր կողքի մահճակալին քնած համածառայող զինվորի կամքին հակառակ, նրա անօգնական վիճակն օգտագործելով՝ կատարել է սեքսուալ բնույթի համասեռական գործողություններ՝ արձակել է տաբատի կոճակները, ձեռքը մտցրել է ներքնաշորի մեջ ու բռնել է անդամից…»:

Հ.-ին մեղադրանք էր առաջադրված ՀՀ քրեական օրենսգրքի   139 հոդվածի 1-ին մասով:

Դատարանում Հ.-ն իրեն լիովին մեղավոր է ճանաչել ու միջնորդել է գործը քննել արագացված կարգով:

Դատարանը հաշվի է առել ծառայության ընթացքում Հ.-ի ստացած շնորհակալագրերը, դրական բնութագրերը:

Հաշվի է առնվել նաև ամբաստանյալի կողմից տուժողի հետ հաշտվելու հանգամանքը, այն, որ նախաքննության ընթացքում կալանքի տակ չգտնվելով՝ Հ.-ն չի խուսափել քննությունից, չի կատարել հակաօրինական որևէ արարք:

Դատարանը Հ.-ին մեղավոր է ճանաչել ՀՀ քրեական օրենսգրքի 139 հոդվածի 1-ին մասով, դատապարտել է  3 տարի ազատազրկման, նրա նկատմամբ պայմանական դատապարտություն է կիրառել և սահմանել է 1 տարի փորձաշրջան:
