«Սասնա ծռերից» 18-ի գործով 15 ամբաստանյալները 6 ժամով հեռացվեցին նիստերի դահլիճից. նիստը հետաձգվեց

Ավան և Նոր Նորք վարչական շրջանների ընդհանուր իրավասության առաջին ատյանի դատարանում շարունակվում է «Սասնա ծռերից»-ից 18-ի՝ Արամ Մանուկյանի, Հովհաննես Հարությունյանի, Թաթուլ Թամրազյանի, Արամ Հակոբյանի, Արթուր Մելքոնյանի, Տիգրան Սարգսյանի, Տիգրան Մանուկյանի, Արայիկ Հակոբյանի, Արթուր Սողոմոնյանի, Գառնիկ Հովակիմյանի, Հովհաննես Վարդանյանի,Վարդան Գերավետյանի, Մարտիրոս Հակոբյանի, Սերգեյ Կյուրեղյանի, Գևորգ Իրիցյանի, Թորոս Թորոսյանի, Մանվել Աթոյանի, Վարդգես Գևորգյանի քրեական գործի քննությունը՝ նախագահող դատավոր Արտուշ Գաբրիելյանի նախագահությամբ։

«Սասնա ծռերի» առաջին դատական նիստն ընթացավ բազմաթիվ ընդմիջումներով, պաշտպանների և ամբաստանյալների նկատմամբ դատական սանկցիաների կիրառմամբ:

Հերթական անգամ դատական նիստի վերսկսումից հետո դատավոր Արտուշ Գաբրիելյանը դատական սանկցիա կիրառեց երեք պաշտպանների նկատմամբ.

«Դատարանը որոշեց դատական սանկցիա կիրառել պաշտպաններ Դավիթ Գյուրջյանի, Արայիկ Պապիկյանի և Նինա Կարապետյանցի նկատմամբ՝ դիմելով Փաստաբանների պալատին նրանց պատասխանատվության ենթարկելու համար»:

Պաշտպան Գրիշա Բալասանյանը տեղից հարց ուղղեց դատավորին, թե նիստի սկզբին քանի հոգի էին մեղադրող դատախազները, հիմա քանիսն են: Դատավորը պատասխանեց, որ նիստի մեկնարկին եղել է չորս մեղադրող դատախազ, իսկ այժմ դատարանում երկուսն են:

«Այդ դեպքում ինչպե՞ս է, որ երբ դատախազները լքում են նիստերի դահլիճը, նրանց նկատմամբ դատական սանկցիա չի կիրառվում, իսկ երբ պաշտպաններն են գնում, նրանց նկատմամբ սանկցիա եք կիրառում: Մենք անհավասար պայմաններում ենք գտնվում»,-ասաց Բալասանյանը:

Բացի դրանից՝ պաշտպանները գրավոր միջնորդություն էին ներկայացրել, որպեսզի դատական նիստը հետաձգվի: Փաստաբան Հայարփի Սարգսյանը լրագրողների հետ զրույցում ասաց՝ քանի դեռ իրենց հնարավորություն չի տրվում բանավոր միջնորդությունը ներկայացնելու, այն ներկայացրել են գրավոր:

Նիստը հետաձգելու մասին միջնորդության հիմքում պաշտպանները նշել էին, որ ամբաստանյալներ կան, որոնց պաշտպանները ներկա չեն: Բացի դրանից՝ իրենք հայտարարությամբ հանդես գալու հնարավորություն չունեն:

Դատավորը միջնորդության վերաբերյալ ասաց, որ այս պահին նախապատրաստական փուլ է, և պաշտպանների ներկայության անհրաժեշտություն չկա. «Երբ պաշտպանները ներգրավվեն գործում, այդ դեպքում էլ նրանց բացակայությունը հաշվի կառնվի»:

Պաշտպանների դիտարկմանը, թե այդ դեպքում ինչպե՞ս են սանկցիա կիրառում այն պաշտպանի նկատմամբ, ով լքում է նիստերի դահլիճը, եթե գործում դեռևս ներգրավված չէ, Արտուշ Գաբրիելյանը պատասխանեց. «Դա դատարանի նկատմամբ անհարգալից վերաբերմունք է»:

Նախագահող դատավորը դատական սանկցիա կիրառեց «Սասնա ծռերից» 15 անդամի նկատմամբ: Բացառությամբ Հովհաննես Հարությունյանի, Թաթուլ Թամրազյանի և Արամ Մանուկյանի՝ մյուս ամբաստանյալները նիստերից դահլիճից հեռացվեցին վեց ժամով:

Դատական նիստը հետաձգվեց, հաջորդ նիստը տեղի կունենա հուլիսի 6-ին:
