Քրեական գործ` մաքսային տեսուչի կողմից պաշտոնեական դիրքի չարաշահման և կեղծիք կատարելու փաստերով

ՀՀ հատուկ քննչական ծառայությունում քրեական գործ է հարուցվել ՀՀ ԿԱ պետական եկամուտների կոմիտեի աշխատակցի վերաբերյալ իրականացված ծառայողական քննության նյութերի հիման վրա:

Այսպես, համաձայն նյութերով ձեռք բերված տվյալների, 2017 թվականի մարտի 3-ին` «Ոչնչացում» մաքսային ընթացակարգով հայտարարագրված ապրանքների ոչնչացման աշխատանքները կազմակերպող և համակարգող հանձնաժողովի անդամների կողմից կատարված հաշվառումից հետո, ոչնչացման նպատակով համապատասխան գործարան է տեղափոխվել դեղորայքի 21 արկղ, որից այրվել է 6-ը: Մնացած 15 արկղի ոչնչացման աշխատանքները հետաձգվել են գործարանի վառարանի անսարքության պատճառով:

Այդ ընթացքում հանձնաժողովի անդամների միջև պայմանավորվածություն է ձեռք բերվել անսարքության վերացումից հետո դեղորայքի ոչնչացման աշխատանքները կրկին կազմակերպել հանձնաժողովի բոլոր անդամների ներկայությամբ:

Սակայն հետագայում մնացած 15 արկղն այրվել է առանց հանձնաժողովի անդամներից մեկի` ՀՀ առողջապահության նախարարության ներկայացուցիչ Վ. Մ.-ի ներկայության: Վերջինս հայտնել է, որ հանձնաժողովի աշխատանքները համակարգող` ՀՀ ԿԱ ՊԵԿ գլխավոր մաքսային տեսուչ Ա. Դ.-ն խախտում է թույլ տվել և անհասկանալի պատճառներով իրեն չի ընդգրկել կիսատ մնացած ոչնչացման աշխատանքների կազմակերպման աշխատանքային խմբում:

Բացի այդ, նյութերի նախապատրաստման ընթացքում տվյալներ են ձեռք բերվել այն մասին, որ հիշյալ մաքսային տեսուչի կողմից դեղերի ոչնչացման աշխատանքը տեսանկարահանելու ժամանակ 15 արկղերից բացվել և ցուցադրվել է միայն 2-ի պարունակությունը, իսկ մնացածն ուղղակի զետեղվել է վառարանում: Ընդ որում, տեսաձայնագրության մեջ դեղորայքի որոշ արկղեր առերևույթ դատարկ են եղել: Այսպիսով, ՊԵԿ աշխատակցի կողմից պաշտոնեական դիրքը չարաշահելու և պաշտոնեական կեղծիք կատարելու դեպքերի առթիվ ՀՀ քրեական օրենսգրքի 308-րդ և 314-րդ հոդվածների 1-ին մասերով հարուցվել է քրեական գործ:

Կատարվում է նախաքննություն: Ծանուցում. ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
