Դատարկ ձայն՝ դատավոր Տաթեւիկ Գրիգորյանից. Եգորյանը՝ Գեւորգ Սաֆարյանին հանրային պաշտպան տրամադրելու որոշման մասին

Գեւորգ Սաֆարյանին հանրային պաշտպան տրամադրելու՝ դատավոր Տաթեւիկ Գրիգորյանի որոշումն ապօրինի է եւ այն կարելի է որակել որպես դատարկ ձայն նախագահող դատավորից: NEWS.am-ի հետ զրույցում նման կարծիք հայտնեց Սաֆարյանի պաշտպան Տիգրան Եգորյանը, որին վարույթից հեռացնելու մասին հուլիսի 4-ին Տաթեւիկ Գրիգորյանը որոշում է կայացրել:
«Այդպիսի որոշում կայացնելու իրավասություն դատավորը չունի այն պարագայում, որ ես շարունակում եմ մնալ Գեւորգ Սաֆարյանի պաշտպանը: Առավել եւս, Գեւորգ Սաֆարյանն էլ է դատարանում հայտարարել, որ չի ցանկանում այլ պաշտպան ունենալ, իսկ հանրային պաշտպան տրամադրելու վերաբերյալ որոշում դատարանն իրավասու չէ կայացնել, քանի որ հանրային պաշտպան տրամադրվում է այն անձանց, որոնք չունեն պաշտպան»,- ասաց Տիգրան Եգորյանը:
Գեւորգ Սաֆարյանի պաշտպանը հերքեց նաեւ Տաթեւիկ Գրիգորյանի այն հայտարարությունը, թե ինքն արդեն 3-րդ նիստն անընդմեջ չի ներկայանում: Տիգրան Եգորյանը հիշեցրեց, որ ինքը չի ներկայացել միայն հուլիսի 4-ին եւ այդ մասին պատշաճ գրություն է ուղարկել դատարանին:
«Մնացած նիստերի մի մասին էլ չեմ մասնակցել, քանի որ իմ պաշտպանյալին հեռացրել են, հետեւաբար հեռացել եմ նաեւ ես, որովհետեւ իմ պաշտպանյալն ինձ չի լիազորել իր բացակայությամբ մասնակցել դատավարությանը»,- ասաց պաշտպան:
Հարցին, թե ինչպես է գնահատում դատավոր Տաթեւիկ Գրիգորյանի գործողություններն ու կայացրած որոշումները, Տիգրան Եգորյանը պատասխանեց. «Եթե դատավոր Տաթեւիկ Գրիգորյանն այս ոգով շարունակի, կգա մի պահ, որ ինքն ու կարգադրիչները մենակ կմնան նիստերի դահլիճում, եթե դա է արդարադատության վերաբերյալ նրա ընկալումները, կարծում եմ, որ Հայաստանի Հանրապետության համար մեծ խնդիր է ունենալ նման դատավոր»:
Հիշեցնենք, որ Ժիրայր Սեֆիլյանի, Գեւորգ Սաֆարյանի եւ մյուս 5 ամբաստանյալների գործով դատավարությունը մեկնարկել է մայիսի 26-ին, սակայն մինչեւ հիմա դատաքննությունը չի սկսվել: Ամեն շաբաթ նիստ հրավիրած դատավոր Տաթեւիկ Գրիգորյանն այս ընթացքում հասցրել է դատական սանկցիաներ կիրառել ամբաստանյալների եւ նրանցից շատերի պաշտպանների նկատմամբ: Հուլիսի 4-ին կայացած նիստում, ի դեպ, մնացել էր ընդամենը 1 ամբաստանյալ եւ 3 պաշտպան: Հետաքրքիր է, որ այդ պաշտպաններից մեկը հանրային պաշտպան Արկադի Գեւորգյանն էր, որին դատարանը ներգրավվեց որպես ամբաստանյալ Գալուստ Գրիգորյանի պաշտպան: Չնայած Գրիգորյանը պնդում էր, որ հրաժարվում է այդ պաշտպանից, Տաթեւիկ Գրիգորյանն անդրդվելի մնաց եւ ներգրավվեց նրան գործում:
