Ըստ «Սարգսյան իրավաբանական խումբ» իրավաբանական միավորման ղեկավար, իրավաբան Տիգրան Սարգսյանի՝ ՀՀ քրեական օրենսգրքի 213-րդ հոդվածի թերի ձևակերպումը բանկերին, վարկային կազմակերպություններին, գրավատներին ստվերային վաշխառությամբ զբաղվելու հնարավորություն է տալիս:
 
Past.am-ի հետ զրույցում Սարգսյանը նշեց, որ համաձայն Քրեական օրենքի՝ վաշխառությունը պարտք տրված դրամի կամ տեսակային հատկանիշով որոշվող գույքի համար Հայաստանի Հանրապետության կենտրոնական բանկի սահմանած բանկային տոկոսի հաշվարկային դրույքի կրկնապատիկը գերազանցող չափով տոկոսներ ստանալն է, ինչպես նաև անձի հետ նրա համար ծայրահեղ ոչ ձեռնտու պայմաններում այլ գործարք կատարելը, որից օգտվել է մյուս կողմը:
 
«Համաձայն օրենքի նորմի ձևակերպման՝ պատժելի է համարվում բանկերի, վարկային կազմակերպությունների, գրավատների պարտք տրված դրամի կամ տեսակային հատկանիշով որոշվող գույքի համար Հայաստանի Հանրապետության կենտրոնական բանկի սահմանած բանկային տոկոսի հաշվարկային դրույքի կրկնապատիկը գերազանցող չափով տոկոսներ ստանալը, այն ինչ անհրաժեշտ էր նախատեսել նաև կիրառվող տույժերի առավելագույն չափերը:Բանն այն է, որ քաղաքացիները, բացի տոկոսներից , ստիպված են լինում վճարել տույժեր և ծառայությունների վճարներ, որոնք կարող են շատ հեռու լինել ողջամիտ համարվելու»,- ընդգծեց մեր զրուցակիցը:
 
Սարգսյանը նշեց նաև, որ ՀՀ քաղաքացիական օրենսգիրքը հնարավորություն է տալիս գործարքը, որն անձը ստիպված է եղել կնքել ծանր հանգամանքների բերումով, իր համար ծայրահեղ ոչ ձեռնտու պայմաններով, որից օգտվել է մյուս կողմը (ստրկացուցիչ գործարք), տուժողի հայցով դատական կարգով ճանաչել անվավեր: Ըստ Սարգսյանի՝ վիճակն այդքան վատ չէր լինի, եթե Ազգային ժողովում բանիմաց և սրտացավ պատգամավորներ ունենայինք, ովքեր կկարողանային օրենսդրությունը համապատասխանացնել մեր քաղաքացիների արդար շահերին:
