Մայրաքաղաքում ու մի շարք մարզերում՝ Արարատում, Արմավիրում վերջին մի քանի օրերին գրանցված +40 աստիճան ջերմությունը դեռևս չի նշանակում, որ մարդիկ կարող են չաշխատել. ՀՀ աշխատանքային օրենսգիրքը չունի հարկադիր հանգստի մասին դրույթ: Փոխարենը, աշխատանքային օրենսգրքի 153-րդ հոդվածով եղանակային նման պայմանների՝ դեպքերում (+40 աստիճանից բարձր կամ -10 աստիճանից ցածր օդի ջերմաստիճանային պայմաններում) նախատեսվում են հատուկ ընդմիջումներ։
Tert.am-ի հետ զրույցում այս մասին հայտնեց ՀՀ աշխատանքի և սոցիալական հարցերի նախարարության աշխատանքի Արփինե Սարգսյանը։
«Ընդմիջումների տևողությունն ու պարբերականությունն օրենքով հստակ սահմանված չէ, դրանք սահմանվում են ներքին կարգապահական կանոններով կամ աշխատանքային պայմանագրով»,-ասաց նա։
Եղանակային այս շոգ պայմաններում հատկապես անմխիթար է շինարարության վրա աշխատող բանվորների ու հասարակական տրանսպորտի վարորդների վիճակը, որոնց չեն գործում ո՛չ հատուկ ընդմիջումները, ո՛չ էլ օրենքի այն պահանջը, որ ջերմաստիճանն աշխատավայրում պետք է համապատասխանի սահմանված նորմերին:

Այսինքն՝ ինչ անի մարդը, եթե աշխատում է դրսում՝ արևի տակ, իսկ գործատուն չի կարող տրամադրել օրենքով նախատեսված ընդմիջումները: Այս դեպքում, ըստ Սոցապնախարարության պաշտոնյայի՝ միակ ելքը դատարան դիմելն է։
