Իրավունք չունեք դատավոր լինելու. պաշտպանները ինքնաբացարկի միջնորդություն ներկայացրին Արտուշ Գաբրիելյանին

Երեւանի Ավան եւ Նոր Նորք վարչական շրջանների ընդհանուր իրավասության դատարանում այսօր` հուլիսի 5-ին, «Սասնա Ծռեր» խմբի 18 անդամների գործով նիստի մեկնարկին Մարտիրոս Հակոբյանի եւ Արայիկ Հակոբյանի շահերի պաշտպան Լուսինե Սահակյանը ինքնաբացարկի միջնորդություն ներկայացրեց դատավոր Արտուշ Գաբրիելյանին` նշելով, որ դատավորը  կոպիտ խախտում է թույլ տվել: Լուսինե Սահակյանի միջնորդությանը միացան դատական նիստին ներկա մյուս փաստաբանները:

«Անգամ ամենահետամնաց երկրում չեմ կարողանում պատկերացնել, որ պաշտպանյալի ձեռքից կարող են խլել այն  նամակը, որն ուղղված է եղել պաշտպանին, առավել եւս կարդալ այն ու հրապարակել: Դուք ընդհանրապես իրավունք չունեք դատական նիստ վարելու, քանի որ այդպիսի խախտում եք թույլ տվել, ընդհանրապես, իրավունք էլ չունեք դատավոր լինելու: Դուք այն դատավորն եք, որի նախագահության ժամանակ բռնություն է գործադրվում մեր պաշտպանյալների նկատմամբ»,-ասաց նա:

Պաշտպաններից Երվանդ Վարոսյանն էլ նշեց, որ դատարանը ինքնաբացարկի միջնորդությունը քննելիս պետք է հիշի, որ նա այն անձն է, ում ձեռքին չգիտես ոնց հայտնվել է  պաշտպանյալի գրած նամակը փաստաբանին եւ այն հրապարակվել է. « Դուք նամակ եք գրել, ինքներդ ձեզ համարել եք դիմող ֆիզիկական անձ, այլ ոչ թե խորհրդակցական սենյակ գնալով եք այդ որոշումը կայացրել»:

Իսկ պաշտպան Գրիշա Բալասանյանը նշեց, որ տեսագրություն կա, որն ապացուցում է, թե ինչպես են քրեական գործով դատախազները հետնամուտքով մտում դատարանի շենք եւ բարձրանում դատավորի գրասենյակ: Նա նշեց, որ հենց դա էլ ապացուցում է այն հանգամանքը, որ դատավոր Արտուշ Գաբրիելյանն անկախ չէ եւ համագործակցում է մեղադրող կողմի հետ:

Նշենք, որ այսօրվա նիստին ներկա է միայն 3 ամբաստանյալ: Դատավոր Արտուշ Գաբրիելյանը նախորդ նիստին վեց ժամով հեռացրել էր «Սասնա Ծռեր» խմբի 18 անդամներից 15-ին. նրանց նկատմամաբ դատական սանկցիա էր կիրառվել ոտքի չկանգնելու համար: Դատարանը սանկցիա չէր կիրառել միայն Հովհաննես Հարությունյանի, Թաթուլ Թամրազյանի եւ Արամ Մանուկյանի նկատմամբ` նշելով, որ նրանք առողջական խնդիրներ ունեն եւ կանգնել չեն կարող: Այսօր պաշտպանները պարզաբանում պահանջեցին, թե ինչու իրենց պաշտպանյալները ներկա չեն նիստին` նշելով, որ նրանց բացակայության պայմաններում նիստ անցկացնելը նրանց իրավունքների կոպիտ խախտում է: Պաշտպանները նաեւ բարձրաձայնեցին ամբաստանյալների պաշտպաններից շատերի բացակայության պայմաններում դատական նիստ անցկացնելու հարցը` նշելով, որ այդպիսով խախտվում են եւ պաշտպանների, եւ ամբաստանյալների իրավունքները:

Մեղադրող Պետրոս Պետրոսյանն առարկեց ներկայացված միջնորդությանը` նշելով, որ այն անհիմն է եւ ենթակա մերժման:

Փաստաբաններ Լուսինե Սահակյանն ու Երվանդ Վարոսյանը դատավորի` խորհրդակցական սենյակ գնալուց առաջ լքեցին դատական նիստերի դահլիճը` նշելով, որ իրենց պաշտպանյալները նիստերի դահլիճում չեն եւ իրենք չեն ցանկանում ներկա գտնվել նիստին:

Դատարանը հեռացավ խորհրդակցական սենյակ` ինքնաբացարկի միջնորդության վերաբերյալ որոշում կայացնելու:

Նշենք, որ այս նիստն անցկացվում է արտագնա. Էրեբունի եւ Նուբարաշեն վարչական շրջանների ընդհանուր իրավասության դատարանի վարույթում քննվող գործով նիստերն անցկացվելու են Երեւանի Ավան եւ Նոր Նորք վարչական շրջանների ընդհանուր իրավասության դատարանում, որտեղ հատուկ «Սասնա Ծռերի» գործը քննելու համար դահլիճն ապակեպատ են դարձրել:

Հիշեցնենք, որ «Սասնա Ծռերի» 14 անդամի գործով նիստերը նույնպես անցկացվում են Ավան եւ Նոր Նորք վարչական շրջանների ընդհանուր իրավասության դատարանում:
